AN ACT to amend the public officers law, relating to establishing and
determining the composition of the committee on gubernatorial inabili-
ty
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The public officers law is amended by adding a new section
2 44 to read as follows:
3 § 44. Committee on gubernatorial inability. 1. In addition to the
4 officials listed in Article IV, Section 9 of the constitution, the
5 committee on gubernatorial inability shall consist of the heads of the
6 following departments and offices, provided they have been confirmed by
7 the senate for their position:
8 a. division of criminal justice services.
9 b. department of health.
10 c. division of human rights.
11 d. department of labor.
12 e. office of mental health.
13 f. department of state.
14 2. The committee on gubernatorial inability shall perform the func-
15 tions set forth in Article IV, Section 9 of the constitution.
16 § 2. This act shall take effect on the same date as a "CONCURRENT
17 RESOLUTION OF THE SENATE AND ASSEMBLY proposing an amendment to article
18 4 of the constitution, in relation to declaring inabilities of the
19 governor, lieutenant-governor and acting governor" takes effect, in
20 accordance with section 1 of article 19 of the constitution.
