AN ACT to amend the public health law in relation to establishing a task
force to handle preventive care in the state of New York if federal
guidelines are changed or rescinded
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The public health law is amended by adding a new section
2 2804-b to read as follows:
3 § 2804-b. Preventive care task force. 1. (a) A state task force is
4 hereby created on clinical preventive practice guidelines and medical
5 technology assessment which shall consist of sixteen members. At least
6 half of the membership shall be physicians specializing in the fields of
7 behavioral health, family medicine, geriatrics, internal medicine,
8 pediatrics, obstetrics and gynecology, and nursing. Appointments shall
9 be made as follows: six shall be appointed by the governor; four shall
10 be appointed by the temporary president of the senate; four shall be
11 appointed by the speaker of the assembly; and one each shall be
12 appointed by the minority leaders of the senate and assembly. The
13 commissioner shall serve as an ex officio member of the task force. The
14 membership of the task force shall appoint a chairperson who shall be
15 selected by a majority vote of the task force membership.
16 (b) Task force members shall serve four year terms.
17 2. For the purposes of this section, the following terms shall have
18 the following meanings: (a) "clinical practice guidelines" shall mean
19 systematically developed statements to assist physician and patient
20 decisions about appropriate health care for specific clinical circum-
21 stances and accompanying preventive care; and
22 (b) "medical technology" shall mean an instrument or unit of equipment
23 or technique for use as a health-related treatment, testing or diagnos-
24 tic tool.

1 3. Task force members shall receive no compensation but shall be reim-
2 bursed for travel expenses incurred in the performance of their duties.
3 4. The task force shall solicit the cooperation and participation of
4 medical specialty organizations recognized by the American Board of
5 Medical Specialties with clinical practice guideline experience in
6 relation to preventive care and consult with relevant authorities
7 regarding insurance coverage for preventive care if federal standards
8 are changed or revoked to ensure continuity of care. The state task
9 force shall meet as necessary to fulfill its responsibilities.
10 § 2. This act shall take effect immediately.
