        AN ACT to amend the public health law, in relation to nonhuman  primates
          in testing and research facilities
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Section 504 of the public health law is amended by adding a
     2  new subdivision 6 to read as follows:
     3    6. (a) For the purposes of this subdivision, the following terms shall
     4  have the following meanings:
     5    (1) "Certified sanctuary" means any facility that  provides  temporary
     6  or permanent safe haven to nonhuman primates that is fully accredited by
     7  the Global Federation of Animal Sanctuaries.
     8    (2)  "Nonhuman  primate"  means  all  nonhuman  members  of  the order
     9  Primates.
    10    (b) Any animal testing facility that no longer has need for a nonhuman
    11  primate in its possession shall, in consultation with such animal  test-
    12  ing  facility's  attending veterinarian, consider options for and deter-
    13  mine the appropriate care and treatment of such nonhuman primate,  which
    14  shall  include offering for release such nonhuman primate to a certified
    15  sanctuary.  Such facility shall make reasonable efforts  to  offer  such
    16  nonhuman primates to a certified sanctuary.  Such animal testing facili-
    17  ty  may  enter  into  an agreement with such certified sanctuary for the
    18  implementation of the provisions of this paragraph.    Nothing  in  this
    19  paragraph  shall  create  a  duty upon a certified sanctuary to accept a
    20  primate offered by a laboratory or institution.
    21    (c) A higher education research facility that receives  public  money,
    22  including  tax-exempt  status,  or  a facility that provides research in
    23  collaboration with a higher education  facility  shall,  no  later  than
    24  ninety  days after this subdivision shall have become a law and annually
    25  thereafter, conspicuously post on its website  the  number  of  nonhuman

     1  primates, listed by species, at the research facility that in the previ-
     2  ous  year  were  placed  in  certified sanctuaries and the names of such
     3  certified sanctuaries.
     4    § 2. This act shall take effect immediately.
