        AN ACT to amend the economic development law, in relation to creating an
          electric school  bus  infrastructure  investment  pilot  program;  and
          making an appropriation relating thereto

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. The economic development law is amended  by  adding  a  new
     2  article 6-B to read as follows:

     5                          INVESTMENT PILOT PROGRAM
     6  Section 189-aa. Electric  school  bus  infrastructure  investment  pilot
     7                    program.

     9    § 189-aa. Electric school bus infrastructure investment pilot program.
    10  (a) The department is authorized and directed to administer an  electric
    11  school  bus  infrastructure  investment  pilot  program. Awards for such
    12  program shall be decided through the existing regional economic develop-
    13  ment council process, with two school  districts  within  each  economic
    14  development  region  being  awarded  grants  on a competitive basis each
    15  year. Such grant money may be used to offset the cost  of  planning  and
    16  building  the  clean energy micro-grids needed to effectuate the conver-
    17  sion to electric buses, including, but not limited to, expenses such  as
    18  engineering, land use, and other studies as may be necessary, as well as
    19  for other purposes deemed feasible and advisable by the department. Such
    20  micro-grid systems shall allow for the clean energy production of charg-
    21  ing  infrastructure,  by producing reduced long term operating expenses,
    22  and reliable power generation to meet the state's goals and mandates  in
    23  this area.

     1    (b)  The  New  York  energy  research  and development authority shall
     2  contribute twenty million dollars' worth  of  its  own  resources,  from
     3  funds  collected  from  ratepayers  for  the purpose of supporting clean
     4  energy programs, reducing emissions and fighting climate change, for the
     5  purposes of carrying out the provisions of this article.
     6    §  189-bb.  Rules  and regulations. The authority, in consultation and
     7  cooperation with the New York energy research and development authority,
     8  is hereby authorized and directed to promulgate  such  rules  and  regu-
     9  lations  as  it deems necessary to fulfill the purposes of this article.
    10  Such rules and regulations  shall  be  promulgated  on  or  before  June
    11  fifteenth, two thousand twenty-six.
    12    § 2. The sum of twenty million dollars ($20,000,000), or so much ther-
    13  eof  as  may  be  necessary, is hereby appropriated to the department of
    14  economic development out of any moneys in  the  state  treasury  in  the
    15  general  fund,  not  otherwise appropriated, and made immediately avail-
    16  able, for the purpose of carrying out the provisions of this  act.  Such
    17  moneys  shall  be payable on the audit and warrant of the comptroller on
    18  vouchers certified or approved by the commissioner of economic  develop-
    19  ment in the manner prescribed by law.
    20    §  3. This act shall take effect April 1, 2026 and shall expire and be
    21  deemed repealed April 1,  2031.  Effective  immediately,  the  addition,
    22  amendment  and/or  repeal  of  any  rule or regulation necessary for the
    23  implementation of this act on its effective date are  authorized  to  be
    24  made and completed on or before such effective date.
