AN ACT to amend the education law, in relation to permitting licensed
pharmacists to prescribe and order certain medications for the
purposes of inducing abortion or expelling a miscarriage
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 6801 of the education law is amended by adding a
2 new subdivision 10 to read as follows:
3 10. (a) A licensed pharmacist acting within their lawful scope of
4 practice may prescribe and order medications approved by the federal
5 food and drug administration for the purposes of inducing abortion or
6 expelling a miscarriage.
7 (b) Prior to dispensing abortion medication, the pharmacist shall:
8 (i) provide a risk assessment questionnaire, developed by the commis-
9 sioner of health in consultation with the commissioner, to be reviewed
10 by the pharmacist to identify any known risk factors; and
11 (ii) provide a fact sheet, developed by the commissioner of health
12 that includes but is not limited to, the clinical considerations and
13 recommendations for use of abortion medication, the appropriate method
14 for using abortion medication, information on the importance of follow-
15 up health care, and health care referral information.
16 (c) No pharmacist shall dispense abortion medication under this subdi-
17 vision without receiving training satisfactory to the commissioner.
18 (d) Nothing in this subdivision shall prevent a pharmacist from refus-
19 ing to prescribe or dispense an order of abortion medication pursuant to
20 this subdivision if, in their professional judgment, potential adverse
21 effects, interactions or other therapeutic complications could endanger
22 the health of the patient.
23 § 2. This act shall take effect immediately.
