AN ACT to direct the office for people with developmental disabilities
to conduct a study on housing models that support independent living
for people with intellectual and developmental disabilities
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. 1. The office for people with developmental disabilities
2 shall conduct a comprehensive study on the feasibility of establishing,
3 implementing, and expanding additional housing models that support inde-
4 pendent living for people with intellectual and developmental disabili-
5 ties. Such study shall examine housing models that:
6 (a) maximize the ability of people with disabilities to choose their
7 own residential environment;
8 (b) allow individuals to select other residents with whom they may
9 share housing accommodations;
10 (c) promote opportunities for independent living with appropriate
11 individualized supports and services;
12 (d) identify barriers within existing state regulations, funding
13 structures, and service delivery systems that limit the development or
14 availability of independent housing options;
15 (e) evaluate successful housing models, pilot programs, and best prac-
16 tices implemented in other states or jurisdictions;
17 (f) assess the availability of public funding opportunities that may
18 support the expansion of independent housing models;

1 (g) provide recommendations for legislative, regulatory, and adminis-
2 trative actions necessary to expand access to such housing models; and
3 (h) include consultation with stakeholders, including people with
4 intellectual and developmental disabilities, family members, direct
5 support professionals, housing providers, advocates, and relevant state
6 and local agencies.
7 2. Such study shall be completed within 12 months of the effective
8 date of this section and a report of the findings, recommendations,
9 proposed implementation strategies, and any proposed legislative or
10 regulatory changes shall be delivered to the governor, the temporary
11 president of the senate, and the speaker of the assembly within 90 days
12 of the completion of the study.
13 § 2. This act shall take effect on the one hundred eightieth day after
14 it shall have become a law.
