AN ACT to amend the public health law and the state finance law, in
relation to requiring opioid antagonists to be stored with all auto-
mated external defibrillators in the state of New York and establish-
ing a grant program to accomplish such goal
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Legislative findings. The legislature finds that opioid
2 overdoses continue to be a leading cause of preventable death in the
3 State of New York. Immediate access to opioid antagonists, such as
4 naloxone nasal spray, can prevent fatalities and save lives. Automated
5 external defibrillators are strategically located in many public places
6 and emergency response settings. By mandating that automated external
7 defibrillator units also include opioid antagonists, New York state will
8 better equip bystanders and first responders to address both cardiac and
9 opioid-related emergencies, thus improving public safety and public
10 health outcomes.
11 § 2. Paragraph (c) of subdivision 1 of section 3000-b of the public
12 health law, as added by chapter 552 of the laws of 1998, is amended to
13 read as follows:
14 (c) "Public access defibrillation provider" means a person, firm,
15 organization or other entity possessing or operating an automated
16 external defibrillator pursuant to a collaborative agreement under this
17 section or public buildings, schools, transportation hubs, places of
18 public assembly, and other locations as designated by the commissioner.
19 § 3. Subdivision 4 of section 3000-b of the public health law is
20 renumbered subdivision 5 and a new subdivision 4 is added to read as
21 follows:
22 4. Opioid antagonists. (a) All public access defibrillation providers
23 shall cause the automated external defibrillator to also contain at
24 least one dose of an opioid antagonist, including but not limited to
25 naloxone nasal spray.

1 (b) The commissioner shall promulgate rules and regulations establish-
2 ing minimum requirements for storage, labeling, replacement, training,
3 and maintenance of opioid antagonists co-located with the automated
4 external defibrillator units.
5 (c) All public access defibrillation providers shall also be responsi-
6 ble for the maintenance and timely replacement of opioid antagonists,
7 including expiration date tracking and proper storage.
8 (d) The department shall make available training resources for the
9 administration of opioid antagonists, including digital and on-site
10 formats, in conjunction with existing automated external defibrillator
11 training requirements.
12 § 4. The public health law is amended by adding a new section 3000-g
13 to read as follows:
14 § 3000-g. Public access defibrillation provider opioid antagonist
15 grant program. 1. There is hereby established a public access defibril-
16 lation provider opioid antagonist grant program to be administered by
17 the department.
18 2. The purpose of such program shall be to provide an incentive and
19 financial assistance to public access defibrillation providers who are
20 seeking to obtain opioid antagonists alongside automated external defi-
21 brillator units.
22 3. The department shall set criteria for eligibility for grant awards.
23 Those eligible to purchase opioid antagonists alongside automated
24 external defibrillator units, and who apply shall be eligible for grant
25 awards under such program. Grants awarded pursuant to this section shall
26 be used solely for the purpose of purchasing opioid antagonists and
27 shall prioritize for schools, libraries, and community centers located
28 in high-risk or underserved areas.
29 4. The public access defibrillation provider opioid antagonist program
30 shall be funded through the annual appropriation of the legislature or
31 any other funds received by the state for the purposes of this section,
32 including but not limited to funds administered in the public access
33 defibrillation provider opioid antagonist grant program fund pursuant to
34 section ninety-nine-tt of the state finance law. Grants shall only be
35 awarded based upon the availability of funds.
36 § 5. The state finance law is amended by adding a new section 99-tt to
37 read as follows:
38 § 99-tt. Public access defibrillation provider opioid antagonist grant
39 program fund. 1. There is hereby established in the joint custody of the
40 state comptroller and the commissioner of the department of health a
41 fund to be known as the "public access defibrillation provider opioid
42 antagonist grant program fund".
43 2. Such fund shall consist of all moneys collected therefor, or moneys
44 credited, appropriated or transferred thereto from any other fund or
45 source pursuant to law, or any other moneys made available for the
46 purposes of the fund.
47 3. Moneys of the fund, following appropriation by the legislature and
48 allocation by the commissioner of the department of health, shall be
49 available only for purposes of the public access defibrillation provider
50 opioid antagonist grant program, as set forth in section three thou-
51 sand-g of the public health law.
52 § 6. This act shall take effect January 1, 2027. Effective immediate-
53 ly, the addition, amendment and/or repeal of any rule or regulation
54 necessary for the implementation of this act on its effective date are
55 authorized to be made and completed on or before such effective date.
