AN ACT to amend the general business law, in relation to requiring that
all new motor vehicles sold at motor vehicle dealerships contain a
space saver tire
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The general business law is amended by adding a new section
2 396-pp to read as follows:
3 § 396-pp. Space saver tire requirement. 1. All new motor vehicles sold
4 at motor vehicle dealerships shall include a space saver tire compatible
5 with the motor vehicle sold. Such tire shall be properly secured to the
6 motor vehicle in a manner that prevents any damage to the motor vehicle.
7 2. This section shall not apply to:
8 (a) new motor vehicles sold with a run-flat tire.
9 (b) motor vehicles that do not have a space to secure a space saver
10 tire.
11 3. Manufacturers shall be responsible for ensuring that all new motor
12 vehicles include a space saver tire compatible with the motor vehicle
13 sold as required by subdivision one of this section.
14 4. For the purposes of this section:
15 (a) "space saver tire" is a temporary smaller sized spare tire that
16 should only be used temporarily, allowing the vehicle to continue to be
17 driven at reduced speeds for limited distances.
18 (b) "run-flat tire" is a pneumatic vehicle tire designed to resist the
19 effects of deflation when punctured, allowing the vehicle to continue to

1 be driven at reduced speeds for limited distances, but cannot replace a
2 spare tire for safety and a longer than expected journey to a repair
3 shop.
4 (c) "motor vehicle" shall have the same meaning as such term is
5 defined in section one hundred twenty-five of vehicle and traffic law.
6 (d) "Manufacturer" shall mean any person, partnership, corporation,
7 association, factory branch or other entity engaged in the business of
8 manufacturing or assembling new and unused motor vehicles for sale in
9 this state.
10 5. Any person that violates the provisions of subdivision one of this
11 section shall be subject to a civil penalty of up to two hundred fifty
12 dollars for a first offense and up to five hundred dollars for any
13 subsequent offense. The provisions of this section shall be enforced
14 concurrently by the director or commissioner of a municipal consumer
15 affairs office, or by the town attorney, city corporation counsel, or
16 other lawful designee of a municipal or local government, and all moneys
17 collected thereunder shall be retained by such municipality or local
18 government.
19 § 2. This act shall take effect on the ninetieth day after it shall
20 have become a law.
