          tee on Election Law
 
        AN ACT to amend the election law, in relation to filing a declination to
          a designation or nomination
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. The opening paragraph of subdivision 6 of section 6-146  of
     2  the  election law is designated paragraph (a) and a new paragraph (b) is
     3  added to read as follows:
     4    (b) A person having not received the nomination of a party  which  was
     5  decided  in  a caucus, may file a certificate of declination to a desig-
     6  nation or nomination, as the case may be, with respect  to  that  office
     7  which  the  person  had filed a designating petition of another party or
     8  had received the nomination after a primary or to a nomination of anoth-
     9  er party decided at a caucus within ten days after  the  certificate  of
    10  nomination  made  pursuant  to  the  caucus which the person had lost is
    11  filed.
    12    § 2. This act shall take effect immediately.
