        Introduced  by M. of A. REYES -- read once and referred to the Committee
          on Governmental Operations
 
        AN ACT to amend the military law, in  relation  to  prohibiting  outside
          militias without permission
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Section 22-a of the military law is amended by adding a new
     2  subdivision 3 to read as follows:
     3    3. a. Notwithstanding any provision of this section to  the  contrary,
     4  no  organized  militia  from  another  state, territory, or district may
     5  enter into this state for the purpose of doing military duty without the
     6  express permission of the governor, unless such militia has been  called
     7  into  federal  service and is acting under authority of the president of
     8  the United States.
     9    b. The attorney general may bring a civil action to enjoin  violations
    10  of this section and seek such other relief as may be appropriate.
    11    §  2. If any clause, sentence, paragraph, subdivision, section or part
    12  of this act shall be adjudged by any court of competent jurisdiction  to
    13  be  invalid,  such  judgment shall not affect, impair, or invalidate the
    14  remainder thereof, but shall be confined in its operation to the clause,
    15  sentence, paragraph,  subdivision,  section  or  part  thereof  directly
    16  involved  in  the  controversy  in  which  such judgment shall have been
    17  rendered. It is hereby declared to be the intent of the legislature that
    18  this act would have been enacted even if such invalid provisions had not
    19  been included herein.
    20    § 3. This act shall take effect immediately.
