Relates to the residence of the part-time judge of the city court of Tonawanda; authorizes the part-time judge of the Tonawanda city court to reside anywhere in Erie county or Niagara county provided such part-time judge's term of office commenced during the two thousand twenty-six calendar year.

AN ACT to amend the uniform city court act, in relation to the residence
of the part-time judge of the city court of Tonawanda; and providing
for the repeal of such provisions upon expiration thereof
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Paragraph 1 of subdivision (b) of section 2104 of the
2 uniform city court act, as amended by chapter 138 of the laws of 2018,
3 is amended to read as follows:
4 (1) be an attorney admitted to practice law in this state for at least
5 five years as of the date [he or she] such judge commences the duties of
6 office, and be a resident of the city in which [he or she] such judge is
7 elected or appointed, except that the judges of the Sherrill city court
8 may reside anywhere in either Oneida or Madison counties, the city court
9 judge who serves in the office that formerly was that of acting judge of
10 the Oneida city court may reside anywhere in Madison county, the judges
11 of the Peekskill city court may reside anywhere in Westchester county,
12 the city court judge who serves in the office that formerly was that of
13 acting judge of the Port Jervis city court may reside anywhere in either
14 Sullivan or Orange counties, the judges of the Hudson city court may
15 reside anywhere in Columbia county, the city court judge who serves in
16 the office that formerly was that of acting judge of the Mechanicville
17 city court may reside anywhere in Saratoga county, the judges of the
18 Ogdensburg city court may reside anywhere in St. Lawrence county, the
19 judges of the Rensselaer city court may reside anywhere in Rensselaer
20 county, the part-time judge of the Lackawanna city court may reside
21 anywhere in Erie county provided [his or her] such part-time judge's
22 term of office commenced during the two thousand eighteen calendar year,
23 the part-time judge of the Tonawanda city court may reside anywhere in
24 Erie county or Niagara county provided such part-time judge's term of

1 office commenced during the two thousand twenty-six calendar year and
2 one judge of the Cohoes city court and the city court judge who serves
3 in the office that formerly was that of acting judge of the Watervliet
4 city court may reside anywhere in Albany county.
5 § 2. Paragraph 1 of subdivision (b) of section 2104 of the uniform
6 city court act, as amended by chapter 548 of the laws of 2013, is
7 amended to read as follows:
8 (1) be an attorney admitted to practice law in this state for at least
9 five years as of the date [he or she] such judge commences the duties of
10 office, and be a resident of the city in which [he or she] such judge is
11 elected or appointed, except that the judges of the Sherrill city court
12 may reside anywhere in either Oneida or Madison counties, the city court

29 the Watervliet city court may reside anywhere in Albany county.
30 § 3. This act shall take effect immediately and shall expire and be
31 deemed repealed on the day the term of office of the first part-time
32 judge of the Tonawanda city court to be appointed during the two thou-
33 sand twenty-six calendar year expires or, on the day such judge other-
34 wise vacates their office, whichever occurs first; provided, that the
35 city of Tonawanda shall notify the legislative bill drafting commission
36 upon the expiration of such judge's term or when such judge vacates
37 their office in order that the commission may maintain an accurate and
38 timely effective data base of the official text of the laws of the state
39 of New York in furtherance of effectuating the provisions of section 44
40 of the legislative law and section 70-b of the public officers law; and
41 provided, further, that the amendments to paragraph 1 of subdivision (b)
42 of section 2104 of the uniform city court act made by section one of
43 this act shall be subject to the expiration and reversion of such para-
44 graph pursuant to section two of chapter 138 of the laws of 2018, as
45 amended, when upon such date the provisions of section two of this act
46 shall take effect.
