        AN ACT to amend the public health law, in relation to replacing the term
          addict with the term person with substance use disorder
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Subdivision 3 of section 3351 of the public health law,  as
     2  amended  by a chapter of the laws of 2025 amending the public health law
     3  relating to authorizing institutional dispensers to dispense  controlled
     4  substances  for  use off premises in an emergency situation for at least
     5  three  days  and  authorizing  practitioners  to   dispense   controlled
     6  substances  for  use  in  maintenance  or detoxification treatment to an
     7  addict or habitual user, as proposed in  legislative  bills  numbers  S.
     8  3416-D and A. 5892-B, is amended to read as follows:
     9    3. A practitioner may prescribe, administer, and dispense any schedule
    10  III, IV, or V narcotic drug approved by the federal food and drug admin-
    11  istration  specifically  for use in maintenance or detoxification treat-
    12  ment to [an addict] a person with substance use disorder    or  habitual
    13  user.
    14    §  2.  This  act  shall  take  effect on the same date and in the same
    15  manner as a chapter of the laws of 2025 amending the public  health  law
    16  relating  to authorizing institutional dispensers to dispense controlled
    17  substances for use off premises in an emergency situation for  at  least
    18  three   days   and  authorizing  practitioners  to  dispense  controlled
    19  substances for use in maintenance  or  detoxification  treatment  to  an
    20  addict  or  habitual  user,  as proposed in legislative bills numbers S.
    21  3416-D and A. 5892-B, takes effect.
