Provides that the governor shall designate staff within their office to act as a liaison to the chair of the not-for-profit contracting advisory committee to assist such advisory committee's interactions with state agencies; provides that the not-for-profit contracting advisory committee shall have the ability to request information from state agencies for reporting purposes and such state agencies shall provide such information to the chair of the not-for-profit contracting advisory committee.

AN ACT to amend the state finance law, in relation to the not-for-profit
contracting advisory committee's interaction with state agencies
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 179-aa of the state finance law, as amended by
2 chapter 672 of the laws of 2019, is amended to read as follows:
3 § 179-aa. Advisory committee. There is hereby established a not-for-
4 profit contracting advisory committee. The advisory committee shall
5 consist of sixteen members which shall include eight appointed members,
6 four to be appointed by the governor who shall be representatives of
7 not-for-profit organizations providing services in the state, and two
8 each to be appointed by the governor upon recommendation of the tempo-
9 rary president of the senate and speaker of the assembly, and eight ex
10 officio members of the committee, one each designated from the division
11 of the budget, the department of law, the office of the state comp-
12 troller, and the education department. The governor shall also designate
13 four members from among the following agencies: the department of state,
14 the office of children and family services, the office of temporary and
15 disability assistance, the department of health, the office of mental
16 hygiene, the office for people with developmental disabilities, and the
17 department of labor. The governor shall designate an appointee to serve
18 as chair of the committee. The governor shall designate staff within
19 their office to act as a liaison to the chair of the advisory committee
20 to assist the advisory committee's interactions with state agencies. The
21 advisory committee shall meet at least quarterly and upon its own initi-
22 ative may: comment and report on the implementation and operation of the
23 not-for-profit short-term revolving loan fund; advise the governor,
24 comptroller and state agencies on the implementation and operation of
25 this article; evaluate the benefits of requiring all state agencies to
26 use standard contract language and the extent to which standard language
27 may be effectively included in contracts with not-for-profit organiza-
28 tions; review annually the report of the office of the state comptroller

1 made pursuant to section one hundred seventy-nine-bb of this article;
2 and propose any legislation they deem necessary to improve the fund and
3 this article. In order for the advisory committee to appropriately
4 report on the aforementioned areas, the advisory committee shall have
5 the ability, through a simple majority vote at a meeting where a quorum
6 is present, to request information from any state agency as it relates
7 to contracting with not-for-profit organizations as outlined in this
8 article. The state agency would then be required to provide such infor-
9 mation to the chair of the advisory committee in writing before the next
10 advisory committee meeting. The next advisory committee meeting shall be
11 at least thirty days after such request so the agency has the ability to
12 gather the requested information or respond in writing as to why they
13 are unable to provide such requested information. The committee shall
14 report to the governor and the legislature with recommendations on
15 improving the contracting procedures with not-for-profit organizations
16 which receive state funds through the intermediary of municipalities.
17 Such reports shall be due annually not later than December first.
18 § 2. This act shall take effect immediately.
