AN ACT to amend the town law and the public officers law, in relation to
waiving the residency requirement for the comptroller and building
inspector in the town of Chester, county of Orange
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 23 of the town law is amended by adding a new
2 subdivision 36 to read as follows:
3 36. Notwithstanding the provisions of subdivision one of this section,
4 in the town of Chester, Orange county, the person performing the func-
5 tion of comptroller or building inspector need not be an elector of such
6 town, provided that such person resides in the county in which such town
7 is located. Provided, however, the person performing the function of
8 comptroller or building inspector in any other town shall be an elector
9 of such town, unless otherwise provided by an act of the state legisla-
10 ture.
11 § 2. Section 3 of the public officers law is amended by adding a new
12 subdivision 75 to read as follows:
13 75. In the town of Chester, in the county of Orange, the provisions of
14 this section requiring a person to be a resident of the political subdi-
15 vision or municipal corporation of the state for which such person shall
16 be chosen or within which such persons official functions are required
17 to be exercised, shall not prevent a person from holding the office of
18 comptroller or building inspector of the town of Chester provided that
19 such person resides in Orange county; provided, however that any person
20 performing such functions or holding the office of comptroller or build-
21 ing inspector in any other town shall be a resident of such county
22 unless otherwise provided by law.
23 § 3. This act shall take effect immediately.
