AN ACT to amend the correction law, in relation to the housing of trans-
gender or intersex incarcerated individuals
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 500-b of the correction law is amended by adding a
2 new subdivision 14 to read as follows:
3 14. Notwithstanding the provisions of this section, a transgender or
4 intersex incarcerated individual may be assigned to any facility housing
5 unit which, upon the determination of the sheriff, ensures the incarcer-
6 ated individual's health and safety and is consistent with facility
7 management and security.
8 § 2. This act shall take effect sixty days after it shall have become
9 a law; provided, however, that the amendments to section 500-b of the
10 correction law made by section one of this act shall not affect the
11 repeal of such section and shall be deemed repealed therewith.
