AN ACT to amend the education law, in relation to required training for
school district officers
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 1 of section 2102-a of the education law, as
2 amended by chapter 388 of the laws of 2010, is amended to read as
3 follows:
4 1. a. Every trustee or voting member of a board of education of a
5 school district or a board of cooperative educational services, elected
6 or appointed for a term beginning on or after July first, two thousand
7 five, shall, within the first year of [his or her] such trustee's or
8 voting member's term, complete a minimum of six hours of training on the
9 financial oversight, accountability and fiduciary responsibilities of a
10 school board member.
11 b. In addition to the training required by paragraph a of this subdi-
12 vision, every trustee or voting member of a board of education of a
13 school district or a board of cooperative educational services, elected
14 or appointed for a [first] term beginning on or after the first of July
15 next succeeding the effective date of this paragraph, shall, within the
16 first year of [his or her] such trustee's or voting member's term,
17 complete a training course to acquaint [him or her] such trustee or
18 voting member with the powers, functions and duties of boards of educa-
19 tion, including, but not limited to, responsibility for adoption of
20 curriculum and instructional materials for courses of study required
21 under this chapter, and responsibility for adoption of curriculum and
22 instructional materials aligned with all New York state learning stand-
23 ards, as well as the powers and duties of other governing and adminis-
24 trative authorities affecting public education. Such training shall

1 include any new or updated laws, rules or regulations relevant to the
2 requirements of this subdivision.
3 c. [Upon demonstration of compliance, no trustee or member of a board
4 of education or a board of cooperative educational services shall be
5 required to repeat the training requirements provided for in paragraphs
6 a and b of this subdivision.] Nothing in this section shall be deemed to
7 require a member of a central high school district board or a member of
8 a board of cooperative educational services to complete such require-
9 ments if such member has already completed such requirements as a member
10 of a board of a component school district. [Nothing in this section
11 shall be deemed to require trustees or voting members of a board of
12 education of a school district or a board of cooperative educational
13 services to complete the requirements of paragraph b of this subdivision
14 if such trustee or member is seated or appointed on or before the effec-
15 tive date of the chapter of the laws of two thousand ten that amended
16 this subdivision.]
17 § 2. This act shall take effect immediately.
