AN ACT to amend the education law, in relation to expedited teaching
licensing by certain military spouses
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 3001 of the education law is amended by adding a
2 new subdivision 4 to read as follows:
3 4. a. Notwithstanding any provision of law to the contrary, any appli-
4 cant seeking to qualify for a license pursuant to this title who is the
5 spouse of an active duty member of the armed forces of the United
6 States, national guard or reserves as defined in 10 U.S.C. sections 1209
7 and 1211, and such spouse is transferred by the military to this state
8 shall be afforded an expedited review of their application for licen-
9 sure. Such application shall be on a form prescribed by the department
10 and shall include an attestation by the applicant of the military status
11 of their spouse and any other such supporting documentation that the
12 department may require. Upon review of such application, the department
13 shall issue a license to the applicant if the applicant holds a license
14 in good standing in another state and in the opinion of the department,
15 the requirements for licensure of such other state are substantially
16 equivalent to the requirements for licensure in this state.
17 b. In addition to the expedited review granted in paragraph a of this
18 subdivision, an applicant who provides satisfactory documentation that
19 they hold a license in good standing from another state, may request the
20 issuance of a temporary practice permit, which, if granted will permit
21 the applicant to work under the supervision of a New York state licensee
22 in accordance with regulations of the commissioner. The department may
23 grant such temporary teaching permit when it appears based on the appli-
24 cation and supporting documentation received that the applicant will
25 meet the requirements for licensure in this state because they hold a

1 license in good standing from another state with significantly compara-
2 ble licensure requirements to those of this state, except the department
3 has not been able to secure direct source verification of the appli-
4 cant's underlying credentials (e.g., receipt of original transcript,
5 experience verification). Such permit shall be valid for six months or
6 until ten days after notification that the applicant does not meet the
7 qualifications for licensure. An additional six months may be granted
8 upon a determination by the department that the applicant is expected to
9 qualify for the full license upon receipt of the remaining direct source
10 verification documents requested by the department in such time period
11 and that the delay in providing the necessary documentation for full
12 licensure was due to extenuating circumstances which the military spouse
13 could not avoid.
14 c. A temporary teaching permit issued under paragraph b of this subdi-
15 vision shall be subject to the full disciplinary and regulatory authori-
16 ty of the board of regents and the department, pursuant to this title,
17 as if such authorization were a professional license issued under this
18 article.
19 d. The department shall reduce the initial licensure application fee
20 by one-half for any application submitted by a military spouse under
21 this subdivision.
22 § 2. This act shall take effect on the one hundred eightieth day after
23 it shall have become a law.
