Prohibits the purchase of single-use plastic products by state agencies, first limiting purchases to be used at any event, briefing, or meeting hosted or sponsored by a state agency in 2030, and a complete prohibition beginning in 2035.

AN ACT to amend the state finance law, in relation to prohibiting the
purchase of single-use plastic products by state agencies
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 165 of the state finance law is amended by adding a
2 new subdivision 10 to read as follows:
3 10. Single-use plastic products. (a) For the purposes of this subdivi-
4 sion:
5 (i) "Single use plastic product" shall mean plastic items intended to
6 be disposed of immediately after use, including plastic and polystyrene
7 food and beverage containers, bottles, straws, cups, cutlery, and
8 disposable plastic bags.
9 (ii) "State agency" shall mean any agency or department over which the
10 governor has executive authority, including all offices and divisions
11 thereof, as well as all public authorities for which the governor
12 appoints the chair, the chief executive, or the majority of board
13 members, including all offices and divisions thereof, except for the
14 Port Authority of New York and New Jersey. State agency shall include
15 the state university of New York and the city university of New York.
16 (b) (i) Beginning January first, two thousand thirty, a state agency
17 shall not purchase any single-use plastic products to be used at any
18 event, briefing, and meetings hosted or sponsored by such state agency.
19 (ii) Beginning January first, two thousand thirty-five, a state agency
20 shall not purchase any single-use plastic products.
21 (c) Nothing in this subdivision shall be construed to prevent the
22 purchase of single-use plastic products by a state agency under the
23 following circumstances:
24 (i) when no alternative is available or practicable;

1 (ii) when necessary to protect the health, safety, and welfare of
2 residents of the state;
3 (iii) when compliance with this section would conflict with contract
4 requirements or labor agreements in existence as of the effective date
5 of this section or agreements solicited before the effective date of
6 this section;
7 (iv) to prepare for or respond to an emergency; or
8 (v) when necessary to provide for disability or accessibility related
9 accommodations.
10 § 2. This act shall take effect immediately.
