        Introduced  by Sen. GALLIVAN -- read twice and ordered printed, and when
          printed to be committed to the Committee on Health
 
        AN ACT to amend the social services law, in relation  to  extending  the
          time where certain entities can provide fiscal intermediary services
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Subdivision 4-a-1 of section 365-f of the  social  services
     2  law, as added by section 3 of part HH of chapter 57 of the laws of 2024,
     3  is amended to read as follows:
     4    4-a-1.  Fiscal  intermediary  registration.  (a)  [Fiscal intermediary
     5  registration.] Except for the  statewide  fiscal  intermediary  and  its
     6  subcontractors,  as  of [April] July first, two thousand twenty-five, no
     7  entity shall provide, directly or through contract, fiscal  intermediary
     8  services. All subcontractors of the statewide fiscal intermediary, shall
     9  register  with  the department within thirty days of being selected as a
    10  subcontractor.
    11    (b) In selecting its subcontractors, the statewide fiscal intermediary
    12  shall consider demonstrated compliance with all applicable  federal  and
    13  state  laws and regulations, including but not limited to, marketing and
    14  labor practices,  cost  reporting,  and  electronic  visit  verification
    15  requirements.
    16    §  2.  This  act  shall take effect immediately and shall be deemed to
    17  have been in full force and effect on and after April 1, 2025.
