AN ACT in relation to creating the state council on scrap tire manage-
ment and recycling; and providing for the repeal of such provisions
upon expiration thereof
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. State council on scrap tire management and recycling. 1.
2 There is hereby created within the executive department a council on
3 scrap tire management and recycling. The council shall consist of a
4 total of seventeen members and shall include the attorney general or a
5 designated representative and the commissioners of economic development,
6 environmental conservation, health, state, and transportation or a depu-
7 ty commissioner of such department as designated by the commissioner
8 thereof. The governor shall appoint the council's eleven at-large
9 members. Two such appointments shall be upon recommendation of the
10 temporary president of the senate, two such appointments shall be upon
11 recommendation of the speaker of the assembly, one such appointment
12 shall be upon recommendation of the minority leader of the senate, and
13 one such appointment shall be upon recommendation of the minority leader
14 of the assembly. Of the remaining five at-large appointments, one member
15 shall be a representative of a local government containing a scrap tire
16 stockpile, one shall be a representative of a municipal planning unit
17 created pursuant to article 27 of the environmental conservation law,
18 one shall be a representative of the tire industry, one shall be a
19 representative of the scrap tire industry, and one shall be a represen-
20 tative of an organization whose prime function is the protection of

1 environmental resources. None of the at-large members so appointed
2 shall be officers or employees of any state department or agency, and
3 each shall be, by professional training or experience and attainment,
4 qualified to analyze and interpret matters pertaining to scrap tire
5 management. Nine members of the council shall constitute a quorum for
6 the transaction of any business of the council.
7 2. The commissioner of environmental conservation and the commissioner
8 of economic development or their designees shall serve as joint chairs
9 of the council.
10 3. The department of environmental conservation and the department of
11 economic development shall provide the council such facilities, assist-
12 ance, and data as will enable the council to carry out its powers and
13 duties. Additionally, all other departments or agencies of the state or
14 subdivisions thereof shall, at the request of the joint chairs, provide
15 the council such facilities, assistance, and data as will enable the
16 council to carry out its powers and duties.
17 4. The council shall recommend to the governor and the legislature, on
18 or before February 1, 2001, a permanent and dedicated funding source,
19 considering various alternatives including those proposed to the council
20 by the department of environmental conservation and the department of
21 economic development, that will support a scrap tire management and
22 recycling program which will include the promotion of recycling and
23 market development.
24 § 2. This act shall take effect immediately and shall expire April 1,
25 2001 when upon such date the provisions of this act shall be deemed
26 repealed.
