          printed to be committed to the Committee on Codes
 
        AN ACT to amend the executive law, in relation to requiring the division
          of criminal justice to create and disseminate to police departments  a
          video on bicycles with electric assist and electric scooters

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 837 of the executive law is amended by adding a new
     2  subdivision 25 to read as follows:
     3    25. In cooperation with the  department  of  motor  vehicles  and  the
     4  department  of  transportation, create and disseminate to police depart-
     5  ments a video on bicycles with electric assist  and  electric  scooters.
     6  Such  video shall include, but not be limited to, the following informa-
     7  tion:
     8    (a) legal classification and definitions  of  bicycles  with  electric
     9  assist and electric scooters, including a visual breakdown of classes of
    10  bicycles with electric assist and scooters, and common misidentification
    11  issues, such as throttle versus pedal-assist;
    12    (b) where such devices may legally operate, including addressing oper-
    13  ation  on streets, bicycle lanes, and sidewalks, in parks and on shared-
    14  use paths, and local opt-out rules;
    15    (c) speed limits and enforcement guidance, including when speed  meas-
    16  urement is required versus when observational enforcement is permissible
    17  and the legal importance of speed versus the practical importance;
    18    (d)  helmet  and age requirements, including when stops or the issuing
    19  of a summons is appropriate and when warnings or education is preferred;
    20  and
    21    (e) a review of legal operation of such devices, including  riding  in
    22  bicycle  lanes, using pedal-assist, and lawful devices operating without
    23  registration or insurance.
    24    § 2. This act shall take effect immediately.
