        Introduced by Sen. PERSAUD -- (at request of the Office of Temporary and
          Disability  Assistance)  --  read  twice and ordered printed, and when
          printed to be committed to the Committee on Social Services
 
        AN ACT to amend chapter 436 of the laws  of  1997  amending  the  social
          services  law  and  other  such  law  relating to enacting The Welfare
          Reform Act of 1997, in relation to changing the name of the office  of
          temporary and disability assistance to the office of economic security
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Paragraph 2 of subdivision (a) of section 122 of part B  of
     2  chapter  436  of  the  laws of 1997 amending the social services law and
     3  other such law relating to enacting The Welfare Reform Act of  1997,  is
     4  amended to read as follows:
     5    (2) the office of [temporary and disability assistance] economic secu-
     6  rity.
     7    §  2.  Notwithstanding  any  other  provisions of law to the contrary,
     8  wherever the  term  "office  of  temporary  and  disability  assistance"
     9  appears  in  the  consolidated  or unconsolidated laws or regulations of
    10  this state, such term shall be deemed to mean "office of economic  secu-
    11  rity".
    12    §  3.  Notwithstanding  any  other  provisions of law to the contrary,
    13  wherever the term "commissioner of temporary and disability  assistance"
    14  appears  in  the  consolidated  or unconsolidated laws or regulations of
    15  this state, such term shall be deemed to mean "commissioner of  economic
    16  security".
    17    §  4.  Terms  occurring in laws, contracts, publications, guidance and
    18  other documents. Notwithstanding any  other  provision  of  law  to  the
    19  contrary, whenever the former department of social services or office of
    20  temporary  and disability assistance is referred to or designated in any
    21  law, contract, publication, guidance,  or  document  pertaining  to  the
    22  functions, powers, obligations and duties of that department transferred
    23  by  chapter 436 of the laws of 1997 to the office of temporary and disa-
    24  bility assistance, such reference or  designation  shall  be  deemed  to
    25  refer to the office of economic security or the commissioner thereof.
 
         EXPLANATION--Matter in italics (underscored) is new; matter in brackets
                              [ ] is old law to be omitted.

     1    § 5. Existing rights and remedies preserved. Notwithstanding any other
     2  provision  of  law  to  the contrary, no existing right or remedy of any
     3  character shall be lost, impaired or affected by reason of this act.
     4    § 6. Severability. If any clause, sentence, paragraph, subdivision, or
     5  section  contained  in this act shall be adjudged by any court of compe-
     6  tent jurisdiction to be invalid, such judgment shall not affect, impair,
     7  or invalidate the remainder thereof, but shall be confined in its opera-
     8  tion to the clause, sentence, paragraph, subdivision,  section  or  part
     9  contained  in  any  part thereof directly involved in the controversy in
    10  which such judgment shall have been rendered. It is hereby  declared  to
    11  be  the  intent of the legislature that this act would have been enacted
    12  even if such invalid provisions had not been included herein.
    13    § 7. This act shall take effect on the one hundred twentieth day after
    14  it shall have become a law.
