        Introduced  by  Sen.  MAYER  -- read twice and ordered printed, and when
          printed to be committed to the Committee on Rules
 
        AN ACT to amend the election law, in relation to  actions  that  may  be
          sought in cases of voter intimidation, deception, or obstruction
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Subdivision 3 of section 17-212 of  the  election  law,  as
     2  added by chapter 226 of the laws of 2022, is amended to read as follows:
     3    3.  Remedies.  Upon  a finding of a violation of any provision of this
     4  section,  the  court  shall  implement  appropriate  remedies  that  are
     5  tailored to remedy the violation, including but not limited to providing
     6  for additional time to cast a ballot that may be counted in the election
     7  at  issue. Actions sought pursuant to this section may include immediate
     8  injunctive relief, restraining orders, or cease  and  desist  orders  to
     9  prevent  irreparable  harm  to  the ability of voters to cast ballots on
    10  days when voting is held.  Any  party  who  shall  violate  any  of  the
    11  provisions  of  the  foregoing section or who shall aid the violation of
    12  any of said provisions shall be liable to any prevailing plaintiff party
    13  for damages, including nominal damages for any violation, and  compensa-
    14  tory or punitive damages for any intentional violation.
    15    § 2. This act shall take effect immediately.
