        AN ACT to amend the  public  officers  law,  in  relation  to  extending
          certain  conflict  of  interest  prohibitions  to spouses, domestic or
          romantic partners, persons residing in the same household, or  immedi-
          ate family members of members of the legislature

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. The public officers law is amended by adding a new  section
     2  75-b to read as follows:
     3    §  75-b.  Conflict of interest of a spouse, domestic or romantic part-
     4  ner, person residing in the same household, or immediate  family  member
     5  of  a  member  of  the legislature. 1. For purposes of this section, any
     6  financial interest, compensation arrangement, contractual relations,  or
     7  other  pecuniary  benefit held by the spouse, domestic or romantic part-
     8  ner, person residing in the same household, or immediate  family  member
     9  of  a  member of the legislature shall be deemed an indirect interest of
    10  such member of the legislature.
    11    2. No spouse, domestic or romantic partner,  person  residing  in  the
    12  same  household,  or immediate family member of a member of the legisla-
    13  ture shall knowingly solicit, negotiate for, accept, or enter  into  any
    14  agreement,  promise, understanding, arrangement, contract, compensation,
    15  or other pecuniary benefit, whether such compensation or other pecuniary
    16  interest is to be paid immediately or at a future date, from any person,
    17  firm, corporation, limited liability  company,  partnership,  developer,
    18  contractor, or other entity that:
    19    (a)  has  a matter pending before a state agency, public authority, or
    20  local governmental entity  within  a  county  in  which  the  legislator
    21  represents any part of; and
    22    (b)  may  reasonably  be expected to benefit financially from official
    23  action, influence, or advocacy involving such legislator.
    24    3. The activities, agreements, or arrangements prohibited pursuant  to
    25  subdivision  two of this section shall be deemed to include any promise,
    26  agreement, understanding, or commitment made  while  the  legislator  is

     1  serving  as  a  member  of  the  legislature, regardless of whether such
     2  compensation or other pecuniary interest is provided before,  while,  or
     3  after such legislator serves as a member of the legislature.
     4    4. Notwithstanding any other provision of the law, a violation of this
     5  section shall be deemed cured if the financial interest, compensation or
     6  other  pecuniary  benefit  is  fully  returned to the payor or otherwise
     7  divested by the spouse, domestic or romantic partner, person residing in
     8  the same household, or immediate family member of a member of the legis-
     9  lature within fourteen days after the legislator or such spouse,  domes-
    10  tic or romantic partner, person residing in the same household, or imme-
    11  diate  family  member  knows  or  reasonably  should  have  known of the
    12  prohibited indirect interest.
    13    § 2. This act shall take effect immediately.
