AN ACT to amend the insurance law and the social services law, in
relation to mandatory health insurance coverage for follow-up screen-
ing or diagnostic services for lung cancer
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subsection (i) of section 3216 of the insurance law is
2 amended by adding a new paragraph 40 to read as follows:
3 (40) (A) Every policy which provides medical, major medical, or simi-
4 lar comprehensive-type coverage shall provide coverage for follow-up
5 screening or diagnostic services for lung cancer when recommended by a
6 health care provider acting within the provider's scope of practice
7 pursuant to title eight of the education law.
8 (B) Notwithstanding any other provision of law, any policy that
9 provides coverage required by this paragraph shall not impose patient
10 cost sharing for follow-up screening or diagnostic services for lung
11 cancer.
12 § 2. Subsection (l) of section 3221 of the insurance law is amended by
13 adding a new paragraph 23 to read as follows:
14 (23) (A) Every policy which provides medical, major medical, or simi-
15 lar comprehensive-type coverage shall provide coverage for follow-up
16 screening or diagnostic services for lung cancer when recommended by a
17 health care provider acting within the provider's scope of practice
18 pursuant to title eight of the education law.
19 (B) Notwithstanding any other provision of law, any policy that
20 provides coverage required by this paragraph shall not impose patient
21 cost sharing for follow-up screening or diagnostic services for lung
22 cancer.

1 § 3. Section 4303 of the insurance law is amended by adding a new
2 subsection (ww) to read as follows:
3 (ww) (1) Every policy which provides medical, major medical, or simi-
4 lar comprehensive-type coverage shall provide coverage for follow-up
5 screening or diagnostic services for lung cancer when recommended by a
6 health care provider acting within the provider's scope of practice
7 pursuant to title eight of the education law.
8 (2) Notwithstanding any other provision of law, any policy that
9 provides coverage required by this subsection shall not impose patient
10 cost sharing for follow-up screening or diagnostic services for lung
11 cancer.
12 § 4. Subdivision 2 of section 365-a of the social services law is
13 amended by adding a new paragraph (nn) to read as follows:
14 (nn) (i) follow-up screening or diagnostic services for lung cancer
15 when recommended by a health care provider acting within the provider's
16 scope of practice pursuant to title eight of the education law.
17 (ii) notwithstanding any other provision of law, coverage required by
18 this paragraph shall not impose patient cost sharing for follow-up
19 screening or diagnostic services for lung cancer.
20 § 5. This act shall take effect January 1, 2027 and shall apply to all
21 policies and contracts issued, renewed, modified, altered or amended on
22 or after such date.
