Enacts the "Greener Highways Act", requiring alternative fuels to be available for public use along the New York state thruway after November 1, 2029 and providing each recommended alternative fuel at least every one hundred twenty miles on both sides of the thruway; defines "alternative fuel".

AN ACT to amend the public authorities law, in relation to the avail-
ability of alternative fuels along the New York state thruway
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Short title. This act shall be known and may be cited as
2 the "Greener Highways Act".
3 § 2. Section 1851 of the public authorities law is amended by adding a
4 new subdivision 19 to read as follows:
5 19. "Alternative fuel" shall mean cellulosic ethanol, renewable
6 diesel, renewable gasoline, bio-diesel, electricity, green hydrogen, and
7 any other fuel identified by the authority which is not petroleum-based,
8 and is consistent with the goals of protecting the safety and health of
9 the public and minimizing emissions of air pollutants, and which is
10 consistent with the climate justice and emission reduction mandates in
11 chapter one hundred six of the laws of two thousand nineteen, and such
12 successors in law and function as may arise from time to time, and any
13 applicable federal alternative fuel requirements.
14 § 3. Section 1855 of the public authorities law is amended by adding a
15 new subdivision 18 to read as follows:
16 18. The authority shall provide the New York state thruway authority
17 with a list of the most feasible alternative fuels, which shall number
18 no fewer than three, and assist the authority in implementing the
19 requirements of section three hundred fifty-four of this chapter.

1 § 4. Subdivision 10 of section 354 of the public authorities law, as
2 amended by section 2 of part TT of chapter 54 of the laws of 2016, is
3 amended to read as follows:
4 10. To construct, reconstruct or improve on or along the thruway in
5 the manner herein provided, suitable facilities for gas stations,
6 restaurants, and other facilities for the public, or to lease the right
7 to construct, reconstruct or improve and operate such facilities; such
8 facilities shall be publicly offered for leasing for operation, or the
9 right to construct, reconstruct or improve and operate such facilities
10 shall be publicly offered under rules and regulations to be established
11 by the authority, provided, however, that lessees operating such facili-
12 ties at the time this act becomes effective, may reconstruct or improve
13 them or may construct additional like facilities, in the manner and upon
14 such terms and conditions as the board shall determine; and provided
15 further, however, that each such facility which contains or consists of
16 a gas station shall, beginning November first, two thousand twenty-nine,
17 include a facility for selling to the public an alternative fuel, as
18 defined in section one thousand eight hundred fifty-one of this chapter
19 and each alternative fuel recommended to the authority by the New York
20 state energy research and development authority pursuant to section one
21 thousand eight hundred fifty-five of this chapter shall be made avail-
22 able at intervals of no more than one hundred twenty miles on each side
23 of the thruway;
24 § 5. This act shall take effect immediately.
