AN ACT to amend the public authorities law, in relation to requiring the
metropolitan transportation authority and the New York city transit
authority to implement certain standards pertaining to applying and
removing coatings from bridges, trestles, elevated subway and railway
tracks and stations
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 1266 of the public authorities law is amended by
2 adding a new subdivision 20 to read as follows:
3 20. The authority shall promulgate regulations to require that all
4 application and maintenance of paint and coatings on bridges, trestles,
5 elevated subway tracks, elevated subway stations, elevated railway
6 tracks and elevated railway stations performed by non-employees of the
7 authority have a quality management program and meet applicable industry
8 standards of the society for protective coatings painting contractor
9 certification program to standards QP-1, QP-2, QP-3, or national associ-
10 ation of corrosion engineers NIICAP AS1 and AS2. The removal, surface
11 preparation, and application of all paint and coatings on authority
12 property, facilities and assets shall be performed by certified workers
13 in accordance with the NACE 13/ACS1 Standard.
14 § 2. Section 1209 of the public authorities law is amended by adding a
15 new subdivision 16 to read as follows:
16 16. The authority shall promulgate regulations to require that all
17 application and maintenance of paint and coatings on bridges, trestles,
18 elevated subway tracks, elevated subway stations, elevated railway
19 tracks and elevated railway stations performed by non-employees of the

5 § 3. This act shall take effect immediately and shall apply to all
6 projects and bids proposed on or after such date and to any contract for
7 which bids or proposals are submitted after such date.
