        Introduced  by  Sens.  LIU, BROUK, COMRIE, HOYLMAN-SIGAL, MAYER, RIVERA,
          SEPULVEDA -- read twice and ordered printed, and when  printed  to  be
          committed to the Committee on Civil Service and Pensions
 
        AN  ACT to amend the civil service law, in relation to the definition of
          public employer and public employee

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1. Paragraphs (a) and (b) of subdivision 1 of section 75-b of
     2  the civil service law, as added by chapter 660 of the laws of 1984,  are
     3  amended to read as follows:
     4    (a)  "Public  employer"  or "employer" shall mean (i) the state of New
     5  York, (ii) a county, city, town, village or any other political subdivi-
     6  sion or civil division of the state, (iii)  a  school  district  or  any
     7  governmental  entity  operating  a public school, college or university,
     8  (iv) a public improvement or special district, (v) a  public  authority,
     9  commission  or  public  benefit corporation, [or] (vi) the unified court
    10  system, (vii) the legislature, or (viii) any other  public  corporation,
    11  agency,  instrumentality  or  unit of government which exercises govern-
    12  mental power under the laws of the state.
    13    (b) "Public employee" or "employee" shall mean any  person,  with  the
    14  exceptions of a judge or justice of the unified court system and members
    15  of  the  legislature, holding a position by appointment or employment in
    16  the service of a public employer  [except  judges  or  justices  of  the
    17  unified court system and members of the legislature].
    18    § 2. This act shall take effect immediately.
