CONCURRENT RESOLUTION OF THE SENATE AND ASSEMBLY
proposing an amendment to section 7 of article 2 of the constitution in
relation to providing identification when voting in person
1 Section 1. Resolved (if the Assembly concur), That section 7 of arti-
2 cle 2 of the constitution be amended to read as follows:
3 § 7. All elections by the citizens, except for such town officers as
4 may by law be directed to be otherwise chosen, shall be by ballot, or by
5 such other method as may be prescribed by law, provided that secrecy in
6 voting be preserved. The legislature shall provide for identification of
7 voters through their signatures and government-issued photo identifica-
8 tion, including but not limited to, a New York state driver's license or
9 non-driver ID; a United States Passport; an identification card issued
10 by a United States educational institution; a United States military
11 identification card; a government issued medical card or any identifica-
12 tion card issued by the United States or the state of New York, in all
13 cases where personal registration is required and shall also provide for
14 the signatures and such government-issued photo identification, at the
15 time of voting, of all persons voting in person by ballot or voting
16 machine, whether or not they have registered in person, save only in
17 cases of illiteracy or physical disability.
18 § 2. Resolved (if the Assembly concur), That the foregoing amendment
19 be referred to the first regular legislative session convening after the
20 next succeeding general election of members of the assembly, and, in
21 conformity with section 1 of article 19 of the constitution, be
22 published for 3 months previous to the time of such election.
