        AN ACT to amend the general municipal law  and  the  education  law,  in
          relation to prohibiting the selling or displaying of symbols of hate
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. The general municipal  law  is  amended  by  adding  a  new
     2  section 99-x to read as follows:
     3    § 99-x. Prohibit symbols of hate.  1. A municipality shall not sell or
     4  display  any  symbols of hate or any similar image, or tangible personal
     5  property, inscribed with such an image unless the  image  appears  in  a
     6  book,  digital  medium,  museum,  or  otherwise serves an educational or
     7  historical purpose.
     8    2. For the purposes of this section, the following  terms  shall  have
     9  the following meanings:
    10    (a) "Symbols of hate" shall include, but not be limited to, symbols of
    11  white  supremacy, neo-Nazi ideology or the Battle Flag of the Confedera-
    12  cy.
    13    (b) "Municipality" shall mean any county, town, village,  city,  board
    14  of  cooperative  educational  services,  other  special district, or any
    15  office or agency thereof.
    16    § 2. The general municipal law is amended  by  adding  a  new  section
    17  209-gg to read as follows:
    18    §  209-gg. Symbols of hate.  1. A fire district, volunteer fire compa-
    19  ny, or police department shall not sell or display any symbols  of  hate
    20  or any similar image, or tangible personal property, inscribed with such
    21  an  image unless the image appears in a book, digital medium, museum, or
    22  otherwise serves an educational or historical purpose.
 
         EXPLANATION--Matter in italics (underscored) is new; matter in brackets
                              [ ] is old law to be omitted.

     5  read as follows:

     7  sell  or  display  any symbols of hate or any similar image, or tangible
     8  personal property, inscribed with such an image unless the image appears
     9  in a book, digital medium, museum, or otherwise serves an educational or
    10  historical purpose.
    11    2. For the purposes of this section, the term "symbols of hate"  shall
    12  include,  but  not  be  limited to, symbols of white supremacy, neo-Nazi
    13  ideology or the Battle Flag of the Confederacy.
    14    § 4. This act shall take effect immediately.
