AN ACT to amend the education law, in relation to providing site mapping
for emergency response data relating to school safety plans
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The opening paragraph and paragraph c of subdivision 3 of
2 section 2801-a of the education law, as amended by section 1 of part B
3 of chapter 54 of the laws of 2016, are amended to read as follows:
4 A building level emergency response plan, developed by the building-
5 level emergency response team defined in subdivision four of this
6 section, shall be kept confidential, including but not limited to the
7 [floor plans, blueprints, schematics or other maps of the school interi-
8 or, school grounds and road maps of the immediate surrounding area,]
9 site mapping for emergency response described in paragraph c of this
10 subdivision and shall not be disclosed except to authorized department
11 or school staff, and law enforcement officers, and shall include the
12 following elements:
13 c. site mapping for emergency response, including floor plans, blue-
14 prints, schematics or other maps of the school interior, school grounds
15 and road maps of the immediate surrounding area. Such site maps shall be
16 provided in a format compatible with software platforms used by local,
17 state, county, and federal law enforcement agencies that provide emer-
18 gency services to the specific school for which the data is provided
19 without requiring law enforcement agencies to purchase additional soft-
20 ware or requiring the integration of third-party software to view the
21 data, and compatible with security software platforms in use by the

1 specific school for which the data is provided without requiring such
2 school and law enforcement agencies to purchase additional software or
3 requiring the integration of third-party software to view the data. Such
4 site maps shall be provided in a printable format, oriented true north,
5 be overlaid with gridded x/y coordinates, and be verified for accuracy
6 through an initial and annual walkthrough of all school buildings and
7 grounds. Districts shall make every effort to provide:
8 i. up-to-date floor plans overlaid on current aerial imagery of a
9 school building and groups;
10 ii. site specific labeling that matches the structure of the school
11 building, including building access points, room labels, hallway names,
12 external door or stairwell numbers, locations of hazardous materials and
13 utility shut offs, key boxes, automated external defibrillators, and
14 trauma kits; and
15 iii. site specific labeling that matches the school grounds, including
16 parking areas, athletic fields, surrounding roads, and neighboring prop-
17 erties.
18 § 2. Section 2801-a of the education law is amended by adding a new
19 subdivision 11 to read as follows:
20 11. For purposes of this section, "site mapping for emergency
21 response" means information provided in an electronic or digital format
22 to assist law enforcement or emergency first responders in an emergency.
23 § 3. Subdivision 6-c of section 3602 of the education law, as amended
24 by chapter 1 of the laws of 2013, and paragraph b as amended by section
25 9 of part A of chapter 56 of the laws of 2023, is amended to read as
26 follows:
27 6-c. a. Building aid for metal detectors, [and] safety devices for
28 electrically operated partitions, room dividers and doors, and site
29 mapping for emergency response. In addition to the apportionments paya-
30 ble to a school district pursuant to subdivision six of this section,
31 the commissioner is hereby authorized to apportion to any school
32 district additional building aid pursuant to this subdivision for its
33 approved expenditures in the base year for the purchase of stationary
34 metal detectors, security cameras, safety devices for electrically oper-
35 ated partitions and room dividers required pursuant to section four
36 hundred nine-f of this chapter, or other security devices approved by
37 the commissioner that increase the safety of students and school person-
38 nel, and for furnishing site mapping for emergency response as required
39 by subdivision three of section two thousand eight hundred one-a of this
40 chapter, provided, however, that funds apportioned to school districts
41 pursuant to this section shall not supplant funds for existing district
42 expenditures or for existing contractual obligations of the district for
43 stationary metal detectors, security cameras, partition and room divider
44 safety devices, [or] security devices, or site mapping for emergency
45 response. Portable or [hand held] handheld metal detectors shall not be
46 eligible for aid pursuant to this subdivision. Such additional aid shall
47 equal the product of the building aid ratio computed for use in the
48 current year pursuant to paragraph c of subdivision six of this section
49 and the actual approved expenditures incurred in the base year pursuant
50 to this subdivision, provided that the limitations on cost allowances
51 prescribed by paragraph a of subdivision six of this section shall not
52 apply. The commissioner shall annually prescribe a special cost allow-
53 ance for metal detectors, and security cameras, and the approved expend-
54 itures shall not exceed such cost allowance. The commissioner shall
55 annually prescribe a special cost allowance for partition and room
56 divider safety devices, and the approved expenditures shall not exceed

1 such cost allowance. The commissioner shall annually prescribe a
2 special cost allowance for site mapping for emergency response, and the
3 approved expenditures shall not exceed such cost allowance.
4 b. For projects approved by the commissioner authorized to receive
5 additional building aid pursuant to this subdivision for the purchase of
6 stationary metal detectors, security cameras or other security devices
7 approved by the commissioner that increase the safety of students and
8 school personnel, provided that for purposes of this paragraph such
9 other security devices shall be limited to electronic security systems
10 and hardened doors, and provided that for projects approved by the
11 commissioner on or after the first day of July two thousand thirteen
12 such additional aid shall equal the product of (i) the building aid
13 ratio computed for use in the current year pursuant to paragraph c of
14 subdivision six of this section plus ten percentage points, except that
15 in no case shall this amount exceed one hundred percent, and (ii) the
16 actual approved expenditures incurred in the base year pursuant to this
17 subdivision, provided that the limitations on cost allowances prescribed
18 by paragraph a of subdivision six of this section shall not apply, and
19 provided further that any projects aided under this paragraph must be
20 included in a district's school safety plan. The commissioner shall
21 annually prescribe a special cost allowance for metal detectors, and
22 security cameras, and the approved expenditures shall not exceed such
23 cost allowance.
24 § 4. This act shall take effect six months after it shall have become
25 a law.
