AN ACT to amend the public authorities law and the administrative code
of the city of New York, in relation to the fifth generation (5G)
telecommunications towers in cities with a population of one million
or more and electric vehicle charging stations
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The public authorities law is amended by adding a new
2 section 1885 to read as follows:
3 § 1885. Fifth generation (5G) telecommunications towers in cities with
4 a population of one million or more and electric vehicle charging
5 stations. 1. For purposes of this section, the following terms shall
6 have the following meanings:
7 (a) "Fifth generation (5G) telecommunications tower" shall mean any
8 freestanding tower, monopole or similar structure used for the provision
9 of fifth generation (5G) wireless services including ancillary telecom-
10 munications equipment required to integrate such tower, monopole or
11 similar structure into an existing or proposed wireless network.
12 (b) "Electric vehicle" shall mean a motor vehicle that is propelled at
13 least in part by an electric motor and associated power electronics
14 which provide acceleration torque to the drive wheels sometime during
15 normal vehicle operation, and that draws electricity from a battery or
16 hydrogen fuel cell that is capable of being recharged from an external
17 source of electricity, such that the external source of electricity
18 cannot be connected to the vehicle while the vehicle is in motion.
19 (c) "Electric vehicle charging station" shall mean the equipment need-
20 ed to convey electric power from the electric grid or another power
21 source to an onboard motor vehicle energy storage system.

1 2. In cities with a population of one million or more, where fifth
2 generation (5G) telecommunications towers are installed and there is
3 street parking available, electric vehicle charging stations shall be
4 provided for public use. Parking spaces designated for the exclusive
5 purpose of charging an electric vehicle at an electric vehicle charging
6 station shall be clearly identified, and such designation shall include
7 conspicuous and permanently installed above grade signs which shall be
8 positioned from the parking space surface at a height of not less than
9 five feet nor more than seven feet and which identify such space as an
10 electric vehicle charging station, indicate that such space is only for
11 electric vehicle charging and include any day or time restrictions.
12 § 2. The administrative code of the city of New York is amended by
13 adding a new section 10-124 to read as follows:
14 § 10-124 Fifth generation (5G) telecommunications towers and electric
15 vehicle charging stations. a. For purposes of this section, the follow-
16 ing terms shall have the following meanings:
17 1. "Fifth generation (5G) telecommunications tower" means any free-
18 standing tower, monopole or similar structure used for the provision of
19 fifth generation (5G) wireless services including ancillary telecommuni-
20 cations equipment required to integrate such tower, monopole or similar
21 structure into an existing or proposed wireless network.
22 2. "Electric vehicle" shall mean a motor vehicle that is propelled at
23 least in part by an electric motor and associated power electronics
24 which provide acceleration torque to the drive wheels sometime during
25 normal vehicle operation, and that draws electricity from a battery or
26 hydrogen fuel cell that is capable of being recharged from an external

32 b. Where fifth generation (5G) telecommunications towers are installed
33 and there is street parking available, spaces for electric vehicle
34 charging stations shall be provided for public use. Parking spaces
35 designated for the exclusive purpose of charging an electric vehicle at
36 an electric vehicle charging station shall be clearly identified, and
37 such designation shall include conspicuous and permanently installed
38 above grade signs which shall be positioned from the parking space
39 surface at a height of not less than five feet nor more than seven feet
40 and which identify such space as an electric vehicle charging station,
41 indicate that such space is only for electric vehicle charging and
42 include any day or time restrictions.
43 § 3. This act shall take effect immediately.
