        Introduced  by  Sen.  COMRIE -- read twice and ordered printed, and when
          printed to be committed to the Committee on Health
 
        AN ACT in relation to directing the department of health  to  conduct  a
          study  relating  to  the  opening  of  a  public hospital in southeast
          Queens; and providing for the repeal of such provisions  upon  expira-
          tion thereof
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. The department of health is hereby authorized and  directed
     2  to  utilize  all  available  data  in partnership with New York hospital
     3  associations, other state agencies, and non-profit entities  to  present
     4  findings  in  a  report  on  immediate  and  future needs for additional
     5  healthcare facilities in southeast Queens.   The  department  of  health
     6  shall  analyze  available  data,  and  make recommendations to assist in
     7  facilitating identified sites in partnership with all  governmental  and
     8  non-governmental  entities  tasked  in  delivering healthcare across New
     9  York city to highlight potential  for  a  new  public  hospital,  trauma
    10  center,  or  other  needed healthcare facility in southeast Queens.  The
    11  department of health shall report on the analysis of all available  data
    12  pertinent  to health needs for southeast Queens from receiving such data
    13  and shall include, but shall not  be  limited  to:  possible  locations,
    14  associated  costs,  proximity  to and availability of public transporta-
    15  tion, demographics of those who may be served, the socio-economic condi-
    16  tion of the area, proximity to other healthcare institutions,  projected
    17  timeline  for opening, and projected process for opening should there be
    18  an immediate and future need for any new hospitals, trauma  centers,  or
    19  other healthcare facilities.
    20    §  2.  The  department  of  health  may  request, and is authorized to
    21  receive, any information from any state agency, hospital association, or
    22  not-for-profit that is relevant and material to the completion  of  such
    23  study  and report. Such information received by the department of health

     1  shall be subject to the same requirements for confidentiality and  limi-
     2  tations  on use, if any, as are applicable to such state agency's use of
     3  such information.
     4    § 3. Within one year of the effective date of this act, the department
     5  of health shall submit a report of its findings, analysis, and recommen-
     6  dations  to  the  governor,  the  temporary president of the senate, the
     7  speaker of the assembly, the chairs of  the  health  committees  in  the
     8  senate  and  assembly,  and  the sponsors of this bill in the senate and
     9  assembly.
    10    § 4. This act shall take effect immediately and shall  expire  and  be
    11  deemed  repealed  thirty  days after the submission of the report to the
    12  governor and the legislature as provided for in section  three  of  this
    13  act; provided that the department of health shall notify the legislative
    14  bill  drafting  commission  upon  the  occurrence of the delivery of the
    15  report provided for in section two of this act in order that the commis-
    16  sion may maintain an accurate and timely  effective  data  base  of  the
    17  official  text  of  the  laws of the state of New York in furtherance of
    18  effectuating the provisions of section 44 of  the  legislative  law  and
    19  section 70-b of the public officers law.
