AN ACT to amend the penal law, in relation to prohibiting the sale of a
firearm, rifle, shotgun or ammunition on state property
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The penal law is amended by adding a new section 265.67 to
2 read as follows:
3 § 265.67 Unlawful sale of a firearm, rifle, shotgun or ammunition on
4 state property.
5 1. For the purposes of this section the term "state property" shall
6 mean all property owned by the state and shall include:
7 (a) all county, city and municipal property; and
8 (b) any fairground located on state, county, city or municipal proper-
9 ty.
10 2. It shall be unlawful for any state officer or employee, or opera-
11 tor, lessee, or licensee of any state property, to contract for, author-
12 ize, or allow the sale of any firearm, rifle, shotgun or ammunition on
13 state property or in the buildings that sit on state property or proper-
14 ty otherwise owned, leased, occupied, or operated by the state.
15 3. This section does not apply to any of the following:
16 (a) A gun buyback event held by a law enforcement agency.
17 (b) The sale of a firearm or ammunition on state property that occurs
18 pursuant to a contract that was entered into before January first, two
19 thousand twenty-six.
20 (c) The purchase of a firearm, rifle, shotgun or ammunition on state
21 property by a law enforcement agency in the course of its regular
22 duties.
23 Unlawful sale of a firearm, rifle, shotgun or ammunition on state
24 property is a class A misdemeanor.
25 § 2. This act shall take effect on the ninetieth day after it shall
26 have become a law.
