AN ACT to amend the agriculture and markets law, in relation to prohib-
iting fractional pricing of certain petroleum products
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 192 of the agriculture and markets law is amended
2 by adding a new subdivision 7 to read as follows:
3 7. No person, firm or corporation shall sell or offer for sale at
4 retail any motor fuel for use in internal combustion engines in motor
5 vehicles or motorboats with a selling price per gallon which includes
6 any fraction of a cent. Failure to comply with the provision of this
7 subdivision shall subject such person, firm or corporation to a civil
8 penalty of up to twenty-five dollars for each day such failure occurs.
9 § 2. Subparagraph (iii) of paragraph a of subdivision 5 of section 192
10 of the agriculture and markets law, as amended by chapter 101 of the
11 laws of 1986, is amended to read as follows:
12 (iii) where a multiple product dispensing device is capable of
13 dispensing multiple products at multiple prices, then the selling price
14 per gallon may be posted thereon with numerals at least one-half that
15 height and one-half that width required by subparagraph (i) of this
16 paragraph[, although numerals representing tenths of a cent may be
17 displayed at no less than one-half those dimensions which disclose the
18 selling price per gallon of such motor fuel dispensed therefrom].
19 § 3. This act shall take effect on the one hundred eightieth day after
20 it shall have become a law. Effective immediately, the commissioner of
21 agriculture and markets is authorized to promulgate any rules and regu-
22 lations necessary to implement this act on or before such effective
23 date.
