        Introduced  by  Sen. HINCHEY -- read twice and ordered printed, and when
          printed to be committed to the Committee on Commerce, Economic  Devel-
          opment and Small Business
 
        AN  ACT  to  amend the alcoholic beverage control law, in relation to an
          exemption for certain property from the prohibition of  alcohol  sales
          within a certain distance of a church

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Subdivision 7 of  section  64  of  the  alcoholic  beverage
     2  control  law  is  amended  by  adding  a new paragraph (e-17) to read as
     3  follows:
     4    (e-17) Notwithstanding the provisions of paragraph (a) of this  subdi-
     5  vision,  the  authority  may  issue  a  retail  license  for on-premises
     6  consumption for a premises which shall be  located  within  two  hundred
     7  feet  of  a  building  occupied as a church, synagogue or other place of
     8  worship, provided such premises constitute a premises for  the  sale  of
     9  food  or  beverages  at  retail  for consumption on the premises located
    10  wholly within the boundaries of the  county  of  Columbia,  bounded  and
    11  described as follows:
    12    ALL  THAT  CERTAIN PIECE OR PARCEL OF LAND situate, lying and being in
    13  the City of Hudson, County of Columbia and the State of New  York,  more
    14  particularly bounded and described as follows:
    15    BEGINNING  at  a  point  formed  by  the  intersection on the presumed
    16  northeasterly line of Warren Street with the presumed southeasterly line
    17  of Fourth Street at or near the corner of the  brick  building  on  this
    18  property;  thence  running  North  44 degrees, 15 minutes and 30 seconds
    19  East for a distance of 77.65 feet and North 44 degrees, 15  minutes  and
    20  30  seconds  East for a distance of 42.35 feet to the presumed southwes-
    21  terly line of Prison Alley; thence running South 45 degrees, 44  minutes
    22  and  30  seconds East for a distance of 20.29 feet, South 45 degrees, 44
    23  minutes and 30 seconds East for a distance of 29.71 feet, and  South  45
 
         EXPLANATION--Matter in italics (underscored) is new; matter in brackets
                              [ ] is old law to be omitted.

     2  the lands now or formerly of White Whale Limited known as 408-410 Warren
     3  Street and described in deed 749 page  1640;  thence  running  South  44
     4  degrees, 15 minutes and 30 seconds West for a distance of 120.00 feet to
     5  the  presumed  northeasterly line of Warren Street; thence running North
     6  45 degrees, 44 minutes and 30 seconds West for a distance of 28.94  feet
     7  and  North  45 degrees, 44 minutes and 30 seconds West for a distance of
     8  50.00 feet to the point or place of beginning.
     9    § 2. This act shall take effect immediately.
