        Introduced  by  Sen.  ORTT  --  read twice and ordered printed, and when
          printed to be committed to the Committee on Commerce, Economic  Devel-
          opment and Small Business
 
        AN  ACT  to  amend  the  alcoholic  beverage control law, in relation to
          allowing for the issuance of a license to sell liquor  at  retail  for
          consumption on certain premises

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Subdivision 7 of  section  64  of  the  alcoholic  beverage
     2  control  law  is  amended  by  adding  a new paragraph (e-13) to read as
     3  follows:
     4    (e-13) Notwithstanding the provisions of paragraph (a) of this  subdi-
     5  vision,  the  authority  may  issue  a  retail  license  for on-premises
     6  consumption for a premises which shall be  located  within  two  hundred
     7  feet  of  a  building  occupied as a church, synagogue or other place of
     8  worship, provided such premises constitute a premises for  the  sale  of
     9  food  or  beverages  at  retail  for consumption on the premises located
    10  wholly within the boundaries of the city of  Niagara  Falls,  county  of
    11  Niagara, bounded and described as follows:
    12    ALL THAT TRACT OR PARCEL OF LAND situate in the City of Niagara Falls,
    13  County of Niagara and State of New York, being part of Lot No. 43 of the
    14  Mile  Reserve and further distinguished as Lots Nos. 2 and 4 as shown on
    15  map made by Jesse P. Haines and filed on December 20, 1861  under  Cover
    16  No.  389,  being  situate on the east line of Second Street, bounded and
    17  described as follows:
    18    BEGINNING at the intersection of the north line of Rainbow  Boulevard,
    19  formerly  Jefferson Avenue and formerly Union Street, with the east line
    20  of Second Street; thence northerly along the east line of Second Street,
    21  a distance of about 106.56 feet to the south line of Lot No.  6;  thence
    22  easterly along the south line of Lot No. 6, a distance of 132.52 feet to
    23  the west line of an alley which is also the east line of Lots Nos. 2 and
 
         EXPLANATION--Matter in italics (underscored) is new; matter in brackets
                              [ ] is old law to be omitted.

     1  4;  thence  southerly  along  the west line of said alley, a distance of
     2  186.8 feet to the north line of Rainbow Boulevard; thence westerly along
     3  the north line of Rainbow Boulevard, as distance of about 154.34 feet to
     4  the east line of Second Street and point of beginning.
     5    § 2. This act shall take effect immediately.
