AN ACT to amend the education law, in relation to prohibiting school
districts from employing certain health professionals if such health
professionals are already employed by another school district
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Paragraph a of subdivision 2 of section 902 of the educa-
2 tion law, as amended by chapter 376 of the laws of 2015, is amended to
3 read as follows:
4 a. The board of education, and the trustee or board of trustees of
5 each school district, shall employ, at a compensation to be agreed upon
6 by the parties, a qualified physician, or a nurse practitioner to the
7 extent authorized by the nurse practice act and consistent with subdivi-
8 sion three of section six thousand nine hundred two of this chapter, to
9 perform the duties of the director of school health services, including
10 any duties conferred on the school physician or school medical inspector
11 under any provision of law, to perform and coordinate the provision of
12 health services in the public schools and to provide health appraisals
13 of students attending the public schools in the city or district;
14 provided, however, that no such board or trustees shall employ a physi-
15 cian or nurse practitioner to perform the duties of the director of
16 school health services if such physician or nurse practitioner is
17 already employed by another school district, unless such board or trus-
18 tees certifies to the commissioner, in a form and manner as determined
19 by the commissioner, that there is a shortage of eligible candidates for
20 such employment within such school district. The physicians or nurse
21 practitioners so employed shall be duly licensed pursuant to applicable
22 law.
23 § 2. This act shall take effect immediately.
