AN ACT in relation to the electrification of the Manhattan Cruise Termi-
nal; and providing for the repeal of such provisions upon expiration
thereof
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. (a) The New York City Economic Development Corporation, in
2 consultation with the department of public service, the department of
3 environmental conservation, Con Edison, the New York state energy
4 research and development authority, the Hudson River Park Trust, other
5 relevant state agencies and authorities with subject matter expertise,
6 shall immediately commence any proceedings, processes, stakeholder
7 engagement, or capital projects necessary for the installation of shore
8 power capability at the Manhattan Cruise Terminal.
9 (b) The process of electrification of the Manhattan Cruise Terminal
10 must be completed, and shore power must be available to vessels calling
11 on the terminal, by December 31, 2030.
12 (c) The New York City Economic Development Corporation in consultation
13 with the New York Power Authority shall issue a competitive award proc-
14 ess to facilitate the electrification of the Manhattan Cruise Terminal.
15 § 2. (a) Upon installation of shore power capabilities at the Manhat-
16 tan Cruise Terminal, the department of environmental conservation shall
17 issue rules or regulations that shall:

1 (i) establish shore power requirements for at berth emission
2 reductions to ensure full use of shore power at the Manhattan Cruise
3 Terminal;
4 (ii) exclude from shore power requirements any government or military
5 vessels; and
6 (iii) enumerate fines and penalties to be levied against vessel opera-
7 tors for violations of the requirements.
8 (b) Nothing in this act shall be construed to amend, repeal, modify,
9 or change any applicable federal laws or regulations, including any
10 United States Coast Guard regulations or requirements.
11 § 3. This act shall take effect immediately and shall expire upon the
12 later of January 1, 2031 or the date upon which the electrification of
13 the Manhattan Cruise Terminal is complete when upon such date this act
14 shall be deemed repealed.
