AN ACT to amend the public health law, in relation to directing parents
file petitions for a child denied school entrance or attendance to the
director of the bureau of immunizations; and to repeal subdivision 6-a
of section 310 of the education law relating thereto
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 6-a of section 310 of the education law is
2 REPEALED.
3 § 2. Paragraph (b) of subdivision 7 of section 2164 of the public
4 health law, as amended by chapter 401 of the laws of 2015, is amended to
5 read as follows:
6 (b) A parent, a guardian or any other person in parental relationship
7 to a child denied school entrance or attendance may appeal by petition
8 to the [commissioner of education in accordance with the provisions of
9 section three hundred ten of the education law] director of the bureau
10 of immunization.
11 § 3. This act shall take effect immediately.
