        AN ACT authorizing the town of Hurley to alienate certain parklands  for
          use  as  a  highway garage for the town and to dedicate other lands as
          replacement parklands

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1. Subject to the provisions of this act, the town of Hurley,
     2  located in the county of Ulster, acting by  and  through  its  governing
     3  body  and  upon such terms and conditions as determined by such body, is
     4  hereby authorized to discontinue as parklands and to alienate the  lands
     5  more  particularly  described  in  section  three  of  this act, for the
     6  purpose of constructing a new highway garage for the town.
     7    § 2. The authorization provided in section one of this  act  shall  be
     8  effective  only  upon the condition that the town of Hurley dedicate the
     9  lands described in section four of this act as parklands, provided  that
    10  the  town  of  Hurley has never used such lands for public open space or
    11  park purposes.
    12    § 3. The parklands authorized by section one of this act to be  alien-
    13  ated are described as follows:
    14    All  that certain piece or parcel of land, situate, lying and being in
    15  the Town of Hurley, Ulster County, and State of  New  York,  being  more
    16  particularly bounded and described as follows:
    17    Beginning at a point on the Northerly line of Lands of Mark Goldstone,
    18  Liber  6427  Page  45  said point also being the Southeasterly corner of
    19  Lands of Marie A. Shultis, Liber 3152 Page 134 and running:
    20    1) thence along the Northeasterly line of Lands of Shultis, North  34°
    21  00'  56" West 1160.87 feet to a point at a Southeasterly corner of other
    22  Lands of the Town of Hurley a 54.437-acre parcel, Liber 1407 Page 34;
 
         EXPLANATION--Matter in italics (underscored) is new; matter in brackets

     1    2) thence along a Southeasterly, Southwesterly and Westerly  lines  of
     2  other  Lands  of  the  Town of Hurley a 54.437-acre parcel the following
     3  courses and distances: North 55° 59' 05" East 393.35 feet to a point;
     4    3) thence South 34° 00' 55" East 252.41 feet to a point;
     5    4) thence South 01° 05' 21" East 48.75 feet to a point;
     6    5) thence South 09° 14' 53" East 59.42 feet to a point;
     7    6) thence South 33° 28' 56" East 70.68 feet to a point;
     8    7) thence South 49° 31' 24" East 84.39 feet to a point;
     9    8) thence South 40° 40' 34" West 212.91 feet to a point;
    10    9)  thence  South  34° 00' 55" East 261.26 feet crossing over Dug Hill
    11  Road to a point;
    12    10) thence along the Southerly side of Dug  Hill  Road  the  following
    13  courses and distances: North 60° 28' 32" East 89.31 feet to a point;
    14    11) thence North 55° 12' 25" East 70.72 feet to a point;
    15    12) thence North 50° 38' 02" East 159.42 feet to a point;
    16    13) thence North 42° 53' 44" East 101.18 feet to a point;
    17    14)  thence  North 28° 42' 00" East 159.85 feet to the intersection of
    18  Dug Hill Road and Froners Road;
    19    15) thence along the Westerly side of Froners Road, South 16° 06'  39"
    20  West  214.46  feet  to  a  point at the Northwesterly corner of Lands of
    21  Goldstone;
    22    16) thence along the Southwesterly line  of  Lands  of  Goldstone  the
    23  following courses and distances: South 21° 00' 35" West 247.10 feet to a
    24  point;
    25    17) thence South 27° 13' 35" West 178.60 feet to a point;
    26    18)  thence  South 32° 32' 35" West 211.50 feet to the place of begin-
    27  ning; having an area of 8.300 Acres of land, more or less.
    28    § 4. Prior to the  discontinuance  and  alienation  of  the  parklands
    29  described  in  section three of this act, the town of Hurley shall dedi-
    30  cate as parklands such land described as follows:
    31    All that certain piece or parcel of land, situate, lying and being  in
    32  the  Town  of  Hurley,  Ulster County, and State of New York, being more
    33  particularly bounded and described as follows:
    34    Beginning at a point on the Southerly side of N.Y.S.  Route  28A  said
    35  point  also being the Northeasterly corner of Lands of Nober Realty LLC,
    36  Liber 5738 Page 93 and running:
    37    1) thence from said point of beginning along  the  Southerly  side  of
    38  N.Y.S.   Route 28A, South 53° 03' 41" East 211.73 feet to a point at the
    39  Northwesterly corner of lands  to  be  retained  by  Town  of  Hurley  a
    40  26.998-acre parcel after revision;
    41    2)  thence  along  Northwesterly line of lands of the Town of Hurley a
    42  26.998-acre parcel after revision, South 29° 20' 06" West  1389.90  feet
    43  to a point at the Southwesterly corner of above-mentioned parcel;
    44    3) thence North 35° 34' 31" West 194.29 to a point at the Northeaster-
    45  ly corner of Lands of Aldel Property 2 LLC, Liber 7750 Page 69;
    46    4)  thence  along  the Northeasterly line of Lands of Aldel Property 2
    47  LLC, North 35° 34' 31" West 260.18 feet to a point at the  Southeasterly
    48  corner of Lands of Nober Realty LLC;
    49    5)  thence  along  the Easterly lines of Lands of Nober Realty LLC the
    50  following courses and distances: North 50° 30' 59" East 656.82 feet to a
    51  point;
    52    6) thence North 19° 07' 19" East 171.07 feet to a point;
    53    7) thence North 26° 39' 59" East 215.35 feet to a point;
    54    8) thence North 16° 05' 39" East 236.87 feet to the  place  of  begin-
    55  ning; having an area of 8.003 Acres of land, more or less.

     1    §  5.  In  the event that the fair market value of the parklands to be
     2  dedicated by the town of Hurley described in section four  of  this  act
     3  are  not equal to or greater than the fair market value of the parklands
     4  to be discontinued in section three of this  act,  the  town  of  Hurley
     5  shall  dedicate  the difference of the fair market value of the lands to
     6  be alienated and the lands to be dedicated for the acquisition of  addi-
     7  tional parklands and/or capital improvements to existing park and recre-
     8  ational facilities.
     9    § 6. In the event that the town of Hurley received any funding support
    10  or assistance from the federal government for the purchase, maintenance,
    11  or  improvement of the parklands set forth in section three of this act,
    12  the discontinuance and alienation of such parklands  authorized  by  the
    13  provisions  of  this  act  shall  not occur until the town of Hurley has
    14  complied with any federal requirements pertaining to the  alienation  or
    15  conversion of parklands, including satisfying the secretary of the inte-
    16  rior  that  the  alienation  or  conversion complies with all conditions
    17  which the secretary of  the  interior  deems  necessary  to  assure  the
    18  substitution of other lands shall be equivalent in fair market value and
    19  usefulness to the lands being alienated or converted.
    20    § 7. This act shall take effect immediately.
