        Introduced  by Sen. HARCKHAM -- read twice and ordered printed, and when
          printed to be committed to the Committee on Rules  --  recommitted  to
          the Committee on Disabilities in accordance with Senate Rule 6, sec. 8
          --  committee  discharged,  bill amended, ordered reprinted as amended
          and recommitted to said committee

        AN ACT to amend the education law, in  relation  to  requiring  same-day
          notification  of  a parent or person in parental relation of a student
          with a disability where certain behavioral interventions are used
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Section  4402 of the education law is amended by adding a
     2  new subdivision 9 to read as follows:
     3    9. The board of education or trustees of each  school  district  shall
     4  develop  a procedure to notify the parent or person in parental relation
     5  of a student with a disability on the same day a physical or  mechanical
     6  restraint is applied on such student or such student is placed in a time
     7  out  room.    When  the  student's parent or person in parental relation
     8  cannot be contacted after reasonable attempts are  made,  the  principal
     9  shall record and report such attempts to the committee on special educa-
    10  tion.
    11    § 2. This act shall take effect immediately.
