AN ACT to amend the public health law and the environmental conservation
law, in relation to the remediation of lead contaminated soil
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 206 of the public health law is amended by adding a
2 new subdivision 33 to read as follows:
3 33. The commissioner in consultation with the commissioner of environ-
4 mental conservation shall require that areas containing lead-contaminat-
5 ed soil shall have the levels of lead contamination decreased to the
6 level of three hundred ppm (parts per million) for residential zoned
7 areas and one thousand ppm for areas zoned for commercial and/or indus-
8 trial development.
9 § 2. Subdivision 1 of section 3-0301 of the environmental conservation
10 law is amended by adding a new paragraph nn to read as follows:
11 nn. Require, in consultation with the commissioner of health, as
12 required by subdivision thirty-three of section two hundred six of the
13 public health law, that areas containing lead-contaminated soil have the
14 levels of lead contamination decreased to the level of three hundred ppm
15 (parts per million) for residential zoned areas and one thousand ppm for
16 areas zoned for commercial and/or industrial development.
17 § 3. This act shall take effect on the ninetieth day after it shall
18 have become a law. Effective immediately, the addition, amendment and/or
19 repeal of any rule or regulation necessary for the implementation of
20 this act on its effective date are authorized to be made and completed
21 on or before such date.
