AN ACT to amend the insurance law, in relation to requiring coverage of
a hospitalized birthing parent's interhospital transport to accompany
their infant needing such transport
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Paragraph 10 of subsection (i) of section 3216 of the
2 insurance law is amended by adding a new subparagraph (C) to read as
3 follows:
4 (C) Coverage provided under this paragraph for maternity care shall
5 include coverage for an interhospital transfer of a hospitalized birth-
6 ing parent to accompany such birthing parent's newborn infant experienc-
7 ing a condition necessitating transport.
8 § 2. Paragraph 5 of subsection (k) of section 3221 of the insurance
9 law is amended by adding a new subparagraph (C) to read as follows:
10 (C) Coverage provided under this paragraph for maternity care shall
11 include coverage for an interhospital transfer of a hospitalized birth-
12 ing parent to accompany such birthing parent's newborn infant experienc-
13 ing a condition necessitating transport.
14 § 3. Subsection (c) of section 4303 of the insurance law is amended by
15 adding a new paragraph 3 to read as follows:
16 (3) Coverage provided under this subsection for maternity care shall
17 include coverage for an interhospital transfer of a hospitalized birth-
18 ing parent to accompany such birthing parent's newborn infant experienc-
19 ing a condition necessitating transport.
20 § 4. This act shall take effect on the one hundred twentieth day after
21 it shall have become a law and shall apply to all policies and contracts
22 issued, renewed, modified, altered or amended on or after such effective
23 date. Effective immediately, the addition, amendment and/or repeal of
24 any rule or regulation necessary for the implementation of this act on
25 its effective date are authorized to be made and completed on or before
26 such effective date.
