AN ACT in relation to continued health coverage in retirement for
certain employees of the city of New York
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Notwithstanding any other provision of law to the contrary,
2 and solely for the purpose of determining vesting for continued health
3 coverage in retirement pursuant to subdivision b of section 12-126 of
4 the administrative code of the city of New York, any employee of the
5 city of New York who transferred from the New York city department of
6 health and mental hygiene to the New York city department of education
7 during November of 2017, and who was previously eligible for retiree
8 health benefits after completion of a defined period of service with the
9 New York city department of health and mental hygiene, shall not be
10 subject to local law number nine of 2010 of the city of New York, shall
11 be deemed to have become employed by the board of education prior to
12 April 27, 2010, and shall be subject to clause (B) of subparagraph 3 of
13 paragraph ii of subdivision a of section 12-126 of the administrative
14 code of the city of New York.
15 § 2. The associated costs of the implementation of this act shall be
16 borne entirely by the city of New York.
17 § 3. This act shall take effect immediately.
