        AN ACT to amend the education law and the public health law, in relation
          to  requiring  opioid  antagonists  in  student  gathering  places  at
          colleges and universities and requiring college and  university  emer-
          gency medical services to carry opioid antagonists
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 922 of the education law, as amended by chapter  68
     2  of the laws of 2016, is amended to read as follows:
     3    §  922.  Opioid  overdose  prevention.  1.  School  districts,  public
     4  libraries, boards of cooperative educational services, county vocational
     5  education  and  extension  boards,  charter  schools,  [and]  non-public
     6  elementary  and  secondary  schools,  universities,  colleges and insti-
     7  tutions in this state [may] shall provide and maintain on-site  in  each
     8  instructional school facility, main student gathering center or library,
     9  opioid  antagonists,  as defined in section three thousand three hundred
    10  nine of the public health law, in quantities and  types  deemed  by  the
    11  commissioner,  in  consultation  with  the commissioner of health, to be
    12  adequate to ensure ready and appropriate access for use during  emergen-
    13  cies  to  any student, individual on library premises or staff suspected
    14  of having opioid overdose whether or not there is a previous history  of
    15  opioid abuse.
    16    2.  School  districts,  public libraries, boards of cooperative educa-
    17  tional services, county vocational education and extension boards, char-
    18  ter schools, [and] non-public elementary and secondary schools,  univer-
    19  sities,  colleges  and  institutions  in this state [may elect to] shall
    20  participate as an opioid antagonist recipient and any person employed by
    21  any such entity [that has elected  to  participate]  may  administer  an
    22  opioid  antagonist  in  the  event  of  an emergency, provided that such
    23  person shall have been trained by a program approved under section three

     1  thousand three hundred  nine  of  the  public  health  law.  Any  school
     2  district,  public  library,  board  of cooperative educational services,
     3  county vocational education and extension board, charter  school,  [and]
     4  non-public  elementary  and  secondary  school,  university, college and
     5  institution that has employees trained in accordance with  this  section
     6  shall  comply  with  the  requirements  of  section three thousand three
     7  hundred nine of the public health law including,  but  not  limited  to,
     8  appropriate  clinical oversight, record keeping and reporting. No person
     9  shall be required to participate in the program and any participation by
    10  an individual shall be voluntary.
    11    § 2. Subparagraph (v) of paragraph (a) of  subdivision  3  of  section
    12  3309  of  the  public health law, as added by chapter 148 of the laws of
    13  2020, is amended to read as follows:
    14    (v) As used in this section, "entity" includes, but is not limited to,
    15  a school district, public  library,  board  of  cooperative  educational
    16  services,  county  vocational  education  and  extension  board, charter
    17  school, non-public elementary  or  secondary  school,  restaurant,  bar,
    18  retail store, shopping mall, barber shop, beauty parlor, theater, sport-
    19  ing  or  event  center,  inn,  hotel [or], motel, university, college or
    20  institution.
    21    § 3. Subdivision 1 of section 3000-b  of  the  public  health  law  is
    22  amended by adding a new paragraph (e) to read as follows:
    23    (e)  "Opioid  antagonist"  shall have the same meaning as set forth in
    24  subparagraph (i) of paragraph (a) of subdivision three of section  thir-
    25  ty-three hundred nine of this chapter.
    26    §  4.  The public health law is amended by adding a new section 3004-b
    27  to read as follows:
    28    § 3004-b. College and university campus  emergency  medical  services;
    29  opioid antagonists. Every emergency medical services system which serves
    30  the  campus of a college or university in the state shall be required to
    31  carry at all times and have readily available an opioid antagonist.  For
    32  the purposes of this section, "opioid antagonist" means naloxone, narcan
    33  or  any  other  medication  approved by the department of health and the
    34  federal food and drug administration that, when administered, negates or
    35  neutralizes in whole or in part the pharmacological effects of an opioid
    36  in the human body.
    37    § 5. The education law is amended by adding a new section 925 to  read
    38  as follows:
    39    §  925.  College  and  university  campus  emergency medical services;
    40  opioid antagonists. Every emergency medical services system which serves
    41  the campus of a college or university in the state shall be required  to
    42  carry  at  all  times  and  have  readily available an opioid antagonist
    43  pursuant to section three thousand four-b of the public health law.
    44    § 6. This act shall take effect on the first of July  next  succeeding
    45  the date on which it shall have become a law. Effective immediately, the
    46  addition,  amendment  and/or  repeal of any rule or regulation necessary
    47  for the implementation of this act on its effective date are  authorized
    48  to be made and completed on or before such effective date.
