AN ACT to amend the racing, pari-mutuel wagering and breeding law, in
relation to video lottery gaming facilities
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 1367 of the racing, pari-mutuel wagering and breed-
2 ing law, as amended by section 3 of part Y of chapter 59 of the laws of
3 2021, subdivision 8 as amended by section 1 of part OO of chapter 59 of
4 the laws of 2025, is amended to read as follows:
5 § 1367. Sports wagering. 1. As used in this section and in section
6 thirteen hundred sixty-seven-a of this title:
7 (a) "Platform provider" means an entity selected by the commission to
8 conduct mobile sports wagering pursuant to a competitive bidding proc-
9 ess;
10 (b) "Authorized sports bettor" means an individual who is physically
11 present in this state when placing a sports wager, who is not a prohib-
12 ited sports bettor, and who participates in sports wagering offered by a
13 casino, a video lottery gaming facility, or a mobile sports wagering
14 licensee;
15 (c) "Casino" means a licensed gaming facility at which gambling is
16 conducted pursuant to the provisions of this article;
17 (d) "Commission" means the New York state gaming commission estab-
18 lished pursuant to section one hundred two of this chapter;
19 (e) "Collegiate sport or athletic event" means a sport or athletic
20 event offered or sponsored by, or played in connection with a public or
21 private institution that offers educational services beyond the second-
22 ary level;
23 (f) "Covered persons" includes: athletes; players; umpires; referees;
24 officials; personnel associated with players, clubs, teams, leagues, and

1 athletic associations; medical professionals, including athletic train-
2 ers, who provide services to athletes and players; and the family
3 members of these persons;
4 (g) "High school sport or athletic event" means a sport or athletic
5 event offered or sponsored by or played in connection with a public or
6 private institution that offers education services at the secondary
7 level;
8 (h) "In-play sports wager" means a sports wager placed on a sports
9 event after the sports event has begun and before it ends;
10 (i) "Layoff bet" means a sports wager placed by a casino or a video
11 lottery gaming facility sports pool with another casino or video lottery
12 gaming facility sports pool;
13 (j) "Minor" means any person under the age of twenty-one years;
14 (k) "Mobile sports wagering platform" or "platform" means the combina-
15 tion of hardware, software, and data networks used to manage, adminis-
16 ter, or control sports wagering and any associated wagers accessible by
17 any electronic means including mobile applications and internet websites
18 accessed via a mobile device or computer;
19 (l) "Mobile sports wagering operator" means a mobile sports wagering
20 skin which has been licensed by the commission to operate a sports pool
21 through a mobile sports wagering platform;
22 (m) "Mobile sports wagering licensee" means a platform provider and a
23 mobile sports wagering operator licensed by the commission;
24 (n) "Operator" means a casino which has elected to operate a sports
25 pool;
26 (o) "Professional sport or athletic event" means an event at which two
27 or more persons participate in sports or athletic events and receive
28 compensation in excess of actual expenses for their participation in
29 such event;
30 (p) "Conduct potentially warranting further investigation" means any
31 statement, action, or other communication intended to unlawfully influ-
32 ence, manipulate, or control a wagering outcome of a sporting contest or
33 performance in a sporting contest in exchange for a benefit or to avoid
34 financial or physical harm. "Conduct potentially warranting further
35 investigation" may include, but not be limited to, statements, actions,
36 and communications made to a covered person;
37 (q) "Professional sports stadium or arena" means a stadium, ballpark,
38 or arena in which a professional sport or athletic event occurs;
39 (r) "Prohibited sports bettor" means:
40 (i) any officer or employee of the commission;
41 (ii) any principal or key employee of a casino, video lottery gaming
42 facility, mobile sports wagering licensee, and its affiliates, except as
43 may be permitted by the commission;
44 (iii) any casino gaming or non-gaming employee at the casino or video
45 lottery gaming facility that employs such person and any gaming or non-
46 gaming employee at the mobile sports wagering licensee that employs such
47 person;
48 (iv) any contractor, subcontractor, or consultant, or officer or
49 employee of a contractor, subcontractor, or consultant, of a casino, a
50 video lottery gaming facility, or a mobile sports wagering licensee if
51 such person is directly involved in the operation or observation of
52 sports wagering, or the processing of sports wagering claims or
53 payments;
54 (v) any person subject to a contract with the commission if such
55 contract contains a provision prohibiting such person from participating
56 in sports wagering;

1 (vi) any spouse, child, sibling or parent residing in the principal
2 place of abode of any of the foregoing persons at the same casino, video
3 lottery gaming facility, or mobile sports wagering licensee where the
4 foregoing person is prohibited from participating in sports wagering;
5 (vii) any amateur or professional athlete if the sports wager is based
6 on any sport or athletic event that the athlete participates in at such
7 amateur or professional level;
8 (viii) any sports agent, owner or employee or independent contractor
9 of a team, player and umpire union personnel, and employee referee,
10 coach or official of a sports governing body, if the sports wager is
11 based on any sport or athletic event overseen by the individual's sports
12 governing body;
13 (ix) any individual placing a wager as an agent or proxy for another
14 person known to be a prohibited sports bettor; or
15 (x) any minor.
16 (s) "Prohibited sports event" means a sport or athletic event in which
17 any New York college team participates regardless of where the event
18 takes place, or high school sport or athletic event. The following shall
19 not be considered prohibited sports events: (i) a collegiate tournament,
20 and (ii) a sports event within such tournament so long as no New York
21 college team is participating in that particular sports event;
22 (t) "Sports event" means any professional sport or athletic event and
23 any collegiate sport or athletic event, except a prohibited sports
24 event;
25 (u) "Sports governing body" means the organization that prescribes
26 final rules and enforces codes of conduct with respect to a sporting
27 event and participants therein;
28 (v) "Sports pool" means the business of accepting wagers on any sports
29 event by any system or method of wagering;
30 (w) "Sports wager" means cash or cash equivalent that is paid by an
31 authorized sports bettor to a casino, a video lottery gaming facility,
32 or a mobile sports wagering licensee to participate in sports wagering
33 offered by such casino, video lottery gaming facility, or mobile sports
34 wagering licensee;
35 (x) "Sports wagering" means wagering on sporting events or any portion
36 thereof, or on the individual performance statistics of athletes partic-
37 ipating in a sporting event, or combination of sporting events, by any
38 system or method of wagering, including, but not limited to, in-person
39 communication and electronic communication through internet websites
40 accessed via a mobile device or computer, and mobile device applica-
41 tions; provided however that sports wagers shall include, but are not
42 limited to, single-game bets, teaser bets, parlays, over-under bets,
43 money line, pools, in-game wagering, in-play bets, proposition bets, and
44 straight bets;
45 (y) "Sports wagering gross revenue" means[: (i)] the amount equal to
46 the total of all sports wagers not attributable to prohibited sports
47 events that a mobile sports wagering licensee collects from all sports
48 bettors, less the total of all sums not attributable to prohibited
49 sports events paid out as winnings to all sports bettors, however, that
50 the total of all sums paid out as winnings to sports bettors shall not
51 include the cash equivalent value of any merchandise or thing of value
52 awarded as a prize;
53 (z) "Sports wagering lounge" means an area wherein a sports pool is
54 operated at a casino or a video lottery gaming facility for placement of
55 in-person wagers;

1 (aa) "Unusual wagering activity" means abnormal wagering activity
2 exhibited by patrons and deemed by the casino, the mobile sports wager-
3 ing licensee, a video lottery gaming facility, or commission pursuant to
4 rules and regulations promulgated by the commission, as a potential
5 indicator of suspicious activity. Abnormal wagering activity may
6 include, but is not limited to, the size of a patron's wager or
7 increased wagering volume on a particular event or wager type;
8 (bb) "Suspicious wagering activity" means unusual wagering activity
9 that cannot be explained and is indicative of match fixing, the manipu-
10 lation of an event, misuse of inside information, or other prohibited
11 activity; [and]
12 (cc) "Independent integrity monitor" means an independent individual
13 or entity approved by the commission to receive reports of unusual
14 wagering activity from a casino, mobile sports wagering licensee, video
15 lottery gaming facility, or commission for the purpose of assisting in
16 identifying suspicious wagering activity; and
17 (dd) "Video lottery gaming facility" means a class two gaming facility
18 owned by a public benefit corporation located in region three of zone
19 one.
20 2. (a) In addition to authorized gaming activities, a casino or a
21 video lottery gaming facility may operate a sports pool upon the
22 approval of the commission and in accordance with the provisions of this
23 section and applicable regulations promulgated pursuant to this article.
24 The commission shall hear and decide promptly and in reasonable order
25 all applications for a license to operate a sports pool, shall have the
26 general responsibility for the implementation of this section and shall
27 have all other duties specified in this section with regard to the oper-
28 ation of a sports pool. The license to operate a sports pool shall be in
29 addition to any other license required to be issued to operate a casino
30 or a video lottery gaming facility. No license to operate a sports pool
31 shall be issued by the commission to any entity unless it has estab-
32 lished its financial stability, integrity and responsibility and its
33 good character, honesty and integrity.
34 No later than five years after the date of the issuance of a license
35 and every five years thereafter or within such lesser periods as the
36 commission may direct, a licensee shall submit to the commission such
37 documentation or information as the commission may by regulation
38 require, to demonstrate to the satisfaction of the executive director of
39 the commission that the licensee continues to meet the requirements of
40 the law and regulations.
41 (b) A sports pool shall be operated in a sports wagering lounge
42 located at a casino or a video lottery gaming facility. The lounge
43 shall conform to all requirements concerning square footage, design,
44 equipment, security measures and related matters which the commission
45 shall by regulation prescribe. Provided, however, the commission may
46 also approve additional locations for a sports pool within the casino or
47 video lottery gaming facility, in areas that have been approved by the
48 commission for the conduct of other gaming, to be operated in a manner
49 and methodology as regulation shall prescribe.
50 (c) The operator of a sports pool shall establish or display the odds
51 at which wagers may be placed on sports events.
52 (d) An operator shall accept wagers on sports events only from persons
53 physically present in the sports wagering lounge, through mobile sports
54 wagering offered pursuant to section thirteen hundred sixty-seven-a of
55 this title, if such operator is also a mobile sports wagering licensee,
56 or any additional locations for a sports pool within the casino,

1 approved by the gaming commission. A person placing a wager shall be at
2 least twenty-one years of age.
3 (e) An operator or mobile sports wagering licensee may also accept
4 layoff bets as long as the authorized sports pool places such wagers
5 with another authorized sports pool or pools in accordance with regu-
6 lations of the commission. A sports pool that places a layoff bet shall
7 inform the sports pool accepting the wager that the wager is being
8 placed by a sports pool and shall disclose its identity.
9 (f) An operator or mobile sports wagering licensee may utilize global
10 risk management pursuant to the approval of the commission.
11 (g) An operator or mobile sports wagering licensee shall not admit
12 into the sports wagering lounge, or accept wagers from, any person whose
13 name appears on the exclusion list.
14 (h) The holder of a license to operate a sports pool may contract with
15 an entity to conduct that operation, in accordance with the regulations
16 of the commission. That entity shall obtain a license as a casino vendor
17 enterprise prior to the execution of any such contract, and such license
18 shall be issued pursuant to the provisions of section one thousand three
19 hundred twenty-seven of this article and in accordance with the regu-
20 lations promulgated by the commission.
21 (i) If any provision of this article or its application to any person
22 or circumstance is held invalid, the invalidity shall not affect other
23 provisions or applications of this article which can be given effect
24 without the invalid provision or application, and to this end the
25 provisions of this article are severable.
26 3. (a) All persons employed directly in wagering-related activities
27 conducted within a sports wagering lounge shall be licensed as a casino
28 key employee or registered as a gaming employee, as determined by the
29 commission. All other employees who are working in the sports wagering
30 lounge may be required to be registered, if appropriate, in accordance
31 with regulations of the commission.
32 (b) Each operator of a sports pool shall designate one or more casino
33 key employees who shall be responsible for the operation of the sports
34 pool. At least one such casino key employee shall be on the premises
35 whenever sports wagering is conducted.
36 4. Except as otherwise provided by this article, the commission shall
37 have the authority to regulate sports pools and the conduct of sports
38 wagering under this article to the same extent that the commission regu-
39 lates other gaming. No casino, video lottery gaming facility, or mobile
40 sports wagering licensee shall be authorized to operate a sports pool
41 unless it has produced information, documentation, and assurances
42 concerning its financial background and resources, including cash
43 reserves, that are sufficient to demonstrate that it has the financial
44 stability, integrity, and responsibility to operate a sports pool. In
45 developing rules and regulations applicable to sports wagering, the
46 commission shall examine the regulations implemented in other states
47 where sports wagering is conducted and shall, as far as practicable,
48 adopt a similar regulatory framework. The commission shall promulgate
49 regulations necessary to carry out the provisions of this section,
50 including, but not limited to, regulations governing the:
51 (a) amount of cash reserves to be maintained by casinos, video lottery
52 gaming facilities, and mobile sports wagering licensees to cover winning
53 wagers;
54 (b) acceptance of wagers on a series of sports events;

1 (c) maximum wagers which may be accepted by a casino, video lottery
2 gaming facility, or mobile sports wagering licensee from any one patron
3 on any one sports event;
4 (d) type of wagering tickets which may be used;
5 (e) method of issuing tickets;
6 (f) method of accounting to be used by casinos, video lottery gaming
7 facilities, and mobile sports wagering licensees;
8 (g) types of records which shall be kept;
9 (h) use of credit and checks by authorized sports bettors;
10 (i) the process by which a casino or a video lottery gaming facility
11 may place a layoff bet;
12 (j) the use of global risk management;
13 (k) type of system for wagering; and
14 (l) protections for a person placing a wager.
15 5. Each casino, video lottery gaming facility, and mobile sports
16 wagering licensee shall adopt comprehensive house rules governing sports
17 wagering transactions with its authorized sports bettors. The rules
18 shall specify the amounts to be paid on winning wagers and the effect of
19 schedule changes. The house rules, together with any other information
20 the commission deems appropriate, shall be conspicuously displayed in
21 the sports wagering lounge and included in the terms and conditions of
22 the account wagering system, and copies shall be made readily available
23 to authorized sports bettors. Mobile sports wagering operators shall
24 develop and prominently display procedures on the main page of such
25 mobile sports wagering operator's platform for the filing of complaints
26 by authorized sports bettors against such mobile sports wagering opera-
27 tor. An initial response shall be given by such mobile sports wagering
28 operator to such bettor filing the complaint within forty-eight hours. A
29 complete response shall be given by such mobile sports wagering operator
30 to such bettor filing the complaint within ten business days. An author-
31 ized sports bettor may file a complaint alleging a violation of the
32 provisions of this article with the commission.
33 6. (a) Each casino, video gaming facility, and mobile sports wagering
34 operator that offers sports wagering shall annually submit a report to
35 the commission no later than the twenty-eighth of February of each year,
36 which shall include the following information:
37 (i) the total amount of sports wagers received from authorized sports
38 bettors;
39 (ii) the total amount of prizes awarded to authorized sports bettors;
40 (iii) the total amount of sports wagering gross revenue received by
41 the casino, video lottery gaming facility, or mobile sports wagering
42 operator;
43 (iv) the total amount of wagers received on each sports governing
44 body's sporting events;
45 (v) the number of accounts held by authorized sports bettors;
46 (vi) the total number of new accounts established in the preceding
47 year, as well as the total number of accounts permanently closed in the
48 preceding year;
49 (vii) the total number of authorized sports bettors that requested to
50 exclude themselves in a prior year who participated in sports wagering;
51 and
52 (viii) any additional information that the commission deems necessary
53 to carry out the provisions of this article.
54 (b) The commission shall annually publish a report based on the aggre-
55 gate information provided by all casinos, video lottery gaming facili-
56 ties, and mobile sports wagering operators pursuant to paragraph (a) of

1 this subdivision, which shall be published on the commission's website
2 no later than one hundred eighty days after the deadline for the
3 submission of individual reports as specified in such paragraph (a).
4 7. For the privilege of conducting sports wagering in the state, casi-
5 nos and video lottery gaming facilities shall pay a tax equivalent to
6 ten percent of their sports wagering gross gaming revenue, excluding
7 sports wagering gross gaming revenue attributed to mobile sports wager-
8 ing offered pursuant to section thirteen hundred sixty-seven-a of this
9 title. Platform providers shall pay a tax constituting a certain
10 percentage of the sports wagering gross gaming revenue attributed to
11 mobile sports wagering offered through such platform provider's platform
12 pursuant to section thirteen hundred sixty-seven-a of this title;
13 provided however, that such percentage shall be determined pursuant to a
14 competitive bidding process conducted by the commission as outlined in
15 subdivision seven of section thirteen hundred sixty-seven-a of this
16 title; and provided further, that such percentage shall be no lower than
17 twelve percent. When awarding a license pursuant to section thirteen
18 hundred sixty-seven-a of this title, the commission may set graduated
19 tax rates; provided however, that any such tax rates may not be lower
20 than the minimum rate established in this subdivision.
21 8. Notwithstanding section thirteen hundred fifty-one of this article,
22 mobile sports wagering gross gaming revenue and tax revenue shall be
23 excluded from sports wagering gross gaming revenue and tax revenue.
24 Mobile sports wagering tax revenue shall be separately maintained and
25 returned to the state for deposit into the state lottery fund for educa-
26 tion aid except as otherwise provided in this subdivision. Any interest
27 and penalties imposed by the commission relating to those taxes, all
28 penalties levied and collected by the commission, and the appropriate
29 funds, cash or prizes forfeited from sports wagering shall be deposited
30 into the state lottery fund for education. In fiscal year two thousand
31 twenty-two, the commission shall pay into the commercial gaming fund one
32 percent of the state tax imposed on mobile sports wagering by this
33 section to be distributed for problem gambling education and treatment
34 purposes pursuant to paragraph a of subdivision four of section ninety-
35 seven-nnnn of the state finance law; provided however, that such amount
36 shall be equal to six million dollars for each fiscal year through
37 fiscal year two thousand twenty-six and twelve million dollars for each
38 fiscal year thereafter, provided that this amount may only be expended
39 pursuant to a plan approved by the director of the budget. In fiscal
40 year two thousand twenty-two, the commission shall pay one percent of
41 the state tax imposed on mobile sports wagering by this section to the
42 general fund, a program to be administered by the office of children and
43 family services for a statewide youth sports activities and education
44 grant program for the purpose of providing annual awards to sports
45 programs for underserved youth under the age of eighteen years; provided
46 however, that such amount shall be equal to five million dollars for
47 each fiscal year thereafter. The commission shall require at least
48 monthly deposits by a platform provider of any payments pursuant to
49 subdivision seven of this section, at such times, under such conditions,
50 and in such depositories as shall be prescribed by the state comp-
51 troller. The deposits shall be deposited to the credit of the state
52 commercial gaming revenue fund. The commission shall require a monthly
53 report and reconciliation statement to be filed with it on or before the
54 tenth day of each month, with respect to gross revenues and deposits
55 received and made, respectively, during the preceding month.

1 9. The commission may perform audits of the books and records of a
2 casino, video lottery gaming facility, or mobile sports wagering licen-
3 see pursuant to section one hundred four of this chapter.
4 10. Nothing in this section shall apply to interactive fantasy sports
5 offered pursuant to article fourteen of this chapter. Nothing in this
6 section authorizes any entity that conducts interactive fantasy sports
7 offered pursuant to article fourteen of this chapter to conduct sports
8 wagering unless it separately qualifies for, and obtains, authorization
9 pursuant to this section.
10 11. A sports governing body may notify the commission that it desires
11 to restrict, limit, or exclude wagering on its sporting events by
12 providing notice in the form and manner as the commission may require.
13 Upon receiving such notice, the commission shall review the request in
14 good faith, seek input from the casinos, video lottery gaming facili-
15 ties, or mobile sports wagering licensees on such a request, and if the
16 commission deems it appropriate, promulgate regulations to restrict such
17 sports wagering.
18 12. (a) When potential criminal activity is suspected by the commis-
19 sion, the commission shall designate the division of the state police to
20 have primary responsibility for assisting the commission in conducting
21 investigations into unusual wagering activity, match fixing, and other
22 conduct that corrupts a wagering outcome of a sporting event or events.
23 (b) Casinos, video lottery gaming facilities, and mobile sports wager-
24 ing licensees shall maintain records of sports wagering operations in
25 accordance with regulations promulgated by the commission. These regu-
26 lations shall, at a minimum, require a casino, video lottery gaming
27 facility, or mobile sports wagering operator to adopt procedures to
28 obtain personally identifiable information from any individual who plac-
29 es any single wager in an amount of ten thousand dollars or greater or
30 making a potential payout or actual payout of ten thousand dollars or
31 greater on a winning wager.
32 (c) Casinos, video lottery gaming facilities, mobile sports wagering
33 licensees and sports governing bodies shall cooperate with the commis-
34 sion to ensure the timely, efficient, and accurate sharing of informa-
35 tion.
36 (d) Casinos, video lottery gaming facilities, mobile sports wagering
37 licensees and sports governing bodies shall cooperate with investi-
38 gations conducted by the commission or law enforcement agencies, includ-
39 ing but not limited to providing or facilitating the provision of
40 account-level wagering information and audio or video files relating to
41 persons placing wagers; provided, however, that the casino, video
42 lottery gaming facility, and mobile sports wagering operator shall not
43 be required to share any personally identifiable information of an
44 authorized sports bettor with any sports governing body unless ordered
45 to do so by the commission, a law enforcement agency or court of compe-
46 tent jurisdiction.
47 (e) (i) Casinos, video lottery gaming facilities, and mobile sports
48 wagering licensees shall promptly report to the commission and any third
49 party integrity monitoring provider approved by the commission, as
50 applicable and in accordance with rules and regulations established by
51 the commission, any information relating to:
52 (1) criminal or disciplinary proceedings commenced against the casino,
53 video lottery gaming facility, or mobile sports wagering licensee in
54 connection with its operations;
55 (2) unusual wagering activity or patterns that may indicate a concern
56 with the integrity of a sporting event or events;

1 (3) any potential breach of the relevant sports governing body's
2 internal rules and codes of conduct pertaining to sports wagering, as
3 they have been provided by the sports governing body to the casino, the
4 video lottery gaming facility, or the mobile sports wagering operator;
5 (4) any other conduct that corrupts a wagering outcome of a sporting
6 event or events, including match fixing; and
7 (5) suspicious or illegal wagering activities, including use of funds
8 derived from illegal activity, wagers to conceal or launder funds
9 derived from illegal activity, using agents to place wagers, using
10 confidential non-public information, and using false identification.
11 (ii) The commission may share information relating to conduct
12 described in clauses two, three and four of subparagraph (i) of this
13 paragraph with the relevant sports governing body.
14 (iii) The commission shall be authorized to share any information
15 under this section with any law enforcement entity, team, sports govern-
16 ing body, or regulatory agency the commission deems appropriate. Such
17 sharing of information may include, but is not limited to, account level
18 wagering information and any audio or video files related to the inves-
19 tigation.
20 (iv) A casino, video lottery gaming facility, or mobile sports wager-
21 ing licensee may be required to share any personally identifiable infor-
22 mation of an authorized sports bettor with a sports governing body only
23 pursuant to an order to do so by the commission, a law enforcement agen-
24 cy or a court of competent jurisdiction.
25 (f) The confidentiality of information shared between a sports govern-
26 ing body and a casino, a video lottery gaming facility, or a mobile
27 sports wagering operator shall be maintained pursuant to all applicable
28 data privacy laws, unless disclosure is required by this section, the
29 commission, other law, or court order. Furthermore, the information
30 shared between a sports governing body, a casino, a video lottery gaming
31 facility, a mobile sports wagering operator or any other party pursuant
32 to this act may not be used for business or marketing purposes by the
33 recipient without the express written approval of the party that
34 provides such information.
35 (g) The commission, by regulation, may authorize and promulgate any
36 rules necessary to implement agreements with other states, or authorized
37 agencies thereof to enable the sharing of information to facilitate
38 integrity monitoring and the conduct of investigations into abnormal
39 wagering activity, match fixing, and other conduct that corrupts a
40 wagering outcome of a sporting event or events.
41 (h) In the event of the creation of an entity that maintains an inter-
42 state database of sports wagering information for the purpose of integ-
43 rity monitoring, the commission may share information and cooperate with
44 such entity pursuant to regulations promulgated by the commission.
45 (i) Casinos, video lottery gaming facilities, and mobile sports wager-
46 ing licensees shall adopt procedures to prevent persons from wagering on
47 sports events who are prohibited from placing sports wagers. A casino,
48 video lottery gaming facility, or mobile sports wagering licensee shall
49 not accept wagers from any person:
50 (i) whose name appears on the exclusion list maintained by the commis-
51 sion and provided to the casino, video lottery gaming facility, or
52 mobile sports wagering licensee;
53 (ii) whose name appears on any self-exclusion list maintained by the
54 commission and provided to the casino, video lottery gaming facility, or
55 mobile sports wagering licensee;

1 (iii) who is the operator, director, officer, owner, or employee of
2 the casino, video lottery gaming facility, or mobile sports wagering
3 licensee or any spouse, child, sibling or parent living in the same
4 principal place of abode as such individual;
5 (iv) who has been identified as a prohibited sports bettor in a list
6 provided by the sports governing body to the commission and casino,
7 video lottery gaming facility, or mobile sports wagering operator, that
8 identifies the individual by such personally identifiable information as
9 specified by rules and regulations promulgated by the commission; or
10 (v) who is an agent or proxy for a prohibited sports bettor.
11 (j) The commission shall establish a method of communication, which
12 may include, but is not limited to a website form, that allows any
13 person to confidentially report information about conduct potentially
14 warranting further investigation to the commission. The identity of any
15 person reporting conduct potentially warranting further investigation to
16 the commission shall remain confidential unless that person authorizes
17 disclosure of [his or her] such person's identity or until such time as
18 the allegation of conduct potentially warranting further investigation
19 is referred to law enforcement. The commission shall promulgate rules
20 governing the investigation and resolution of a charge of any person
21 purported to have engaged in conduct potentially warranting further
22 investigation.
23 13. The commission shall promulgate rules that require a casino, video
24 lottery gaming facility, or mobile sports wagering [licensees] licensee
25 to implement responsible gaming programs that include comprehensive
26 employee trainings on responding to circumstances in which individuals
27 present signs of a gambling addiction and requirements for casinos and
28 mobile sports wagering licensees under section thirteen hundred sixty-
29 seven-a of this title to assess, prevent, and address problem gaming by
30 such casino's or mobile sports wagering licensee's users.
31 14. For purposes of wager determination, the commission shall provide
32 a preference for the use of official league data unless the use of other
33 objective wager determination criteria has been justified to the satis-
34 faction of the commission.
35 15. The conduct of sports wagering in violation of this section is
36 prohibited.
37 16. (a) In addition to any criminal penalties provided for under arti-
38 cle two hundred twenty-five of the penal law, any person, firm, corpo-
39 ration, association, agent, or employee, who is not authorized to offer
40 sports wagering under this section or section thirteen hundred sixty-
41 seven-a of this title, and who knowingly offers or attempts to offer
42 sports wagering or mobile sports wagering in New York shall be liable
43 for a civil penalty of not more than one hundred thousand dollars for
44 each violation, not to exceed five million dollars for violations aris-
45 ing out of the same transaction or occurrence, which shall accrue to the
46 state and may be recovered in a civil action brought by the attorney
47 general.
48 (b) Any person, firm, corporation, association, agent, or employee who
49 knowingly violates any procedure implemented under this section, or
50 section thirteen hundred sixty-seven-a of this title, shall be liable
51 for a civil penalty as described in section one hundred sixteen of this
52 chapter which shall accrue to the state and may be recovered in a civil
53 action brought by the commission.
54 17. All sports wagers placed in accordance with this section at a
55 video lottery gaming facility are considered placed or otherwise made
56 when received by the video lottery gaming facility on such video lottery

1 gaming facility's server or other equipment used to accept sports wagers
2 at a licensed commercial casino, regardless of the authorized sports
3 bettor's physical location within the state at the time the sports wager
4 is placed.
5 § 2. This act shall take effect immediately.
