        Introduced  by  Sen.  CLEARE -- read twice and ordered printed, and when
          printed to be committed to the Committee on Crime Victims,  Crime  and
          Correction
 
        AN ACT to amend the correction law, in relation to requiring the commis-
          sioner  of  corrections and community supervision to assess and update
          the security camera, land-mobile radio, and public address systems  in
          use in correctional facilities
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 112 of the correction law is amended  by  adding  a
     2  new subdivision 7 to read as follows:
     3    7.  (a)  Not  later  than ninety days after the effective date of this
     4  subdivision, the commissioner shall:
     5    (i) evaluate  the  security  camera,  land-mobile  radio,  and  public
     6  address  systems  in  use in correctional facilities as of the effective
     7  date of this subdivision; and
     8    (ii) submit to the governor and the legislature a  plan  for  ensuring
     9  that  all  correctional facilities have the security camera, land-mobile
    10  radio, and public address system coverage and capabilities necessary to:
    11    (1) ensure the health and safety of staff  and  incarcerated  individ-
    12  uals; and
    13    (2)  ensure the documentation and accessibility of video evidence that
    14  may pertain to misconduct by staff or incarcerated  individuals,  negli-
    15  gent  or  abusive  treatment  of  incarcerated  individuals, or criminal
    16  activity within correctional facilities.
    17    (b) The plan required pursuant to paragraph (a)  of  this  subdivision
    18  shall:
    19    (i)  identify  and  include  plans  to address any deficiencies in the
    20  security camera system in  use  at  correctional  facilities,  including
    21  those related to:
    22    (1) an insufficient number of cameras;

     1    (2) inoperable or malfunctioning cameras;
     2    (3) blind spots;
     3    (4) poor quality video; and
     4    (5) any other deficits in the security camera system;
     5    (ii)  identify  and  include  plans to adopt and maintain any security
     6  camera system upgrades needed to achieve the purposes described in para-
     7  graph (a) of this subdivision, including:
     8    (1) conversion of all analog cameras to digital surveillance  systems,
     9  with corresponding infrastructure and equipment upgrade requirements;
    10    (2)  upgrades to ensure the secure storage, logging, preservation, and
    11  accessibility of recordings such that the recordings  are  available  to
    12  investigators or courts at such time as may be reasonably required; and
    13    (3) additional camera system capabilities needed to enhance the safety
    14  and security of incarcerated individuals and staff;
    15    (iii)  include  an  assessment of operational and logistical consider-
    16  ations in implementing the plan required pursuant to  paragraph  (a)  of
    17  this subdivision, including:
    18    (1) a prioritization of facilities for needed upgrades, beginning with
    19  high security institutions;
    20    (2) the personnel and training necessary to implement the changes; and
    21    (3) ongoing repair and maintenance requirements; and
    22    (iv)  include a two-year strategic plan and cost projection for imple-
    23  menting the changes and upgrades to  the  security  camera,  land-mobile
    24  radio,  and  public  address  systems identified under subparagraphs (i)
    25  through (iii) of this paragraph.
    26    (c) Not later than two years after the  date  on  which  the  plan  is
    27  submitted  pursuant to subparagraph (ii) of paragraph (a) of this subdi-
    28  vision, and subject to appropriations therefor, the  commissioner  shall
    29  complete implementation of the submitted plan.
    30    (d)  Beginning  one year after the date on which the plan is submitted
    31  pursuant to subparagraph (ii) of paragraph (a) of this subdivision,  and
    32  each   year  thereafter  until  full  implementation  of  such  plan  is
    33  completed, the commissioner shall issue  a  public  report  to  be  made
    34  available  on  the  website  of  the  department on the progress of such
    35  implementation.
    36    § 2. This act shall take effect immediately.
