        AN ACT to amend the education law, in relation to providing  transporta-
          tion after four o'clock
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Subdivision 4 of section 3627  of  the  education  law,  as
     2  amended  by section 13-a of part A of chapter 56 of the laws of 2024, is
     3  amended to read as follows:
     4    4. Notwithstanding any other provision of law  to  the  contrary,  any
     5  expenditures for transportation provided pursuant to this section in the
     6  two  thousand thirteen--two thousand fourteen school year and thereafter
     7  and otherwise eligible for transportation aid  pursuant  to  subdivision
     8  seven of section thirty-six hundred two of this article shall be consid-
     9  ered  approved  transportation expenses eligible for transportation aid,
    10  provided further that for the two thousand thirteen--two thousand  four-
    11  teen  school year such aid shall be limited to eight million one hundred
    12  thousand dollars and for the two thousand fourteen--two thousand fifteen
    13  school year such aid shall be limited to the sum of twelve  million  six
    14  hundred  thousand  dollars plus the base amount and for the two thousand
    15  fifteen--two thousand sixteen school year  through  two  thousand  eigh-
    16  teen--two thousand nineteen school year such aid shall be limited to the
    17  sum  of  eighteen  million eight hundred fifty thousand dollars plus the
    18  base amount and for  the  two  thousand  nineteen--two  thousand  twenty
    19  school  year  such  aid  shall be limited to the sum of nineteen million
    20  three hundred fifty thousand dollars plus the base amount  and  for  the
    21  two  thousand twenty--two thousand twenty-one school year such aid shall
    22  be limited to the sum of nineteen million eight hundred  fifty  thousand
    23  dollars  plus  the  base amount and for the two thousand twenty-two--two
    24  thousand twenty-three school year such aid shall be limited to  the  sum
    25  of twenty-two million three hundred fifty thousand dollars plus the base

     1  amount  and  for the two thousand twenty-three--two thousand twenty-four
     2  school year such aid shall be limited to the sum of twenty-four  million
     3  eight  hundred  fifty  thousand dollars plus the base amount and for the
     4  two  thousand  twenty-four--two  thousand  twenty-five  school year [and
     5  thereafter] such aid shall be limited to the sum of twenty-nine  million
     6  eight  hundred fifty thousand dollars plus the base amount. For purposes
     7  of this subdivision, "base amount" means the  amount  of  transportation
     8  aid  paid  to  the  school district for expenditures incurred in the two
     9  thousand twelve--two thousand thirteen school  year  for  transportation
    10  that  would have been eligible for aid pursuant to this section had this
    11  section been in effect in such school year, except that subdivision  six
    12  of this section shall be deemed not to have been in effect. And provided
    13  further  that  the school district shall continue to annually expend for
    14  the transportation described in subdivision one of this section at least
    15  the expenditures used for the base [amount]  year,  including,  but  not
    16  limited  to  increases  in  the  reimbursable  transportation  cost  per
    17  student.
    18    § 1-a. Subdivision 4 of section 3627 of the education law, as  amended
    19  by  section  12 of part A of chapter 56 of the laws of  2025, is amended
    20  to read as follows:
    21    4. Notwithstanding any other provision of law  to  the  contrary,  any
    22  expenditures for transportation provided pursuant to this section in the
    23  two  thousand thirteen--two thousand fourteen school year and thereafter
    24  and otherwise eligible for transportation aid  pursuant  to  subdivision
    25  seven of section thirty-six hundred two of this article shall be consid-
    26  ered  approved  transportation expenses eligible for transportation aid,
    27  provided further that for the two thousand thirteen--two thousand  four-
    28  teen  school year such aid shall be limited to eight million one hundred
    29  thousand dollars and for the two thousand fourteen--two thousand fifteen
    30  school year such aid shall be limited to the sum of twelve  million  six
    31  hundred  thousand  dollars plus the base amount and for the two thousand
    32  fifteen--two thousand sixteen school year  through  two  thousand  eigh-
    33  teen--two thousand nineteen school year such aid shall be limited to the
    34  sum  of  eighteen  million eight hundred fifty thousand dollars plus the
    35  base amount and for  the  two  thousand  nineteen--two  thousand  twenty
    36  school  year  such  aid  shall be limited to the sum of nineteen million
    37  three hundred fifty thousand dollars plus the base amount  and  for  the
    38  two  thousand twenty--two thousand twenty-one school year such aid shall
    39  be limited to the sum of nineteen million eight hundred  fifty  thousand
    40  dollars  plus  the  base amount and for the two thousand twenty-two--two
    41  thousand twenty-three school year such aid shall be limited to  the  sum
    42  of twenty-two million three hundred fifty thousand dollars plus the base
    43  amount  and  for the two thousand twenty-three--two thousand twenty-four
    44  school year such aid shall be limited to the sum of twenty-four  million
    45  eight  hundred  fifty  thousand dollars plus the base amount and for the
    46  two thousand twenty-four--two thousand twenty-five school year such  aid
    47  shall  be  limited to the sum of twenty-nine million eight hundred fifty
    48  thousand dollars plus the base amount and for the two  thousand  twenty-
    49  five--two  thousand twenty-six school year and thereafter such aid shall
    50  be limited to the product of (i) the maximum amount of aid authorized by
    51  this subdivision for the base year, and (ii) the sum  of  one  plus  the
    52  product  of  (a)  two  and  one-half  multiplied  by  (b) the percentage
    53  increase in the consumer price index  as  defined  in  paragraph  hh  of
    54  subdivision  one  of section thirty-six hundred two of this article. For
    55  purposes of this subdivision, "base amount" means the amount  of  trans-
    56  portation  aid  paid to the school district for expenditures incurred in

     1  the two thousand twelve--two thousand thirteen school year for transpor-
     2  tation that would have been eligible for aid pursuant  to  this  section
     3  had  this section been in effect in such school year, except that subdi-
     4  vision  six  of this section shall be deemed not to have been in effect.
     5  And provided further that the school district shall continue to annually
     6  expend for the transportation  described  in  subdivision  one  of  this
     7  section  at  least  the  expenditures  used  for the base [amount] year,
     8  including, but not limited to increases in the reimbursable  transporta-
     9  tion cost per student.
    10    § 2. This act shall take effect July 1, 2025; provided that the amend-
    11  ments  to  subdivision  4  of  section 3627 of the education law made by
    12  section one of this act shall take effect on the same date  and  in  the
    13  same  manner  as section 12 of part A of chapter 56 of the laws of 2025,
    14  takes effect.
