AN ACT to amend the alcoholic beverage control law and the agriculture
and markets law, in relation to authorizing retail licensees of liquor
and/or wine for off-premises consumption to apply for licensure as a
retail food store
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The alcoholic beverage control law is amended by adding a
2 new section 132 to read as follows:
3 § 132. Retail licensees of liquor and/or wine for off-premises
4 consumption authorized to apply for retail food store licenses. 1. A
5 retail licensee of liquor and/or wine for off-premises consumption shall
6 be authorized to apply for licensure as a retail food store. Such appli-
7 cation shall be made in the form and manner as set forth in subdivision
8 five of section five hundred of the agriculture and markets law.
9 2. For purposes of this section, "retail food store" shall have the
10 same meaning as set forth in paragraph (b) of subdivision one of section
11 five hundred of the agriculture and markets law.
12 § 2. The agriculture and markets law is amended by adding a new
13 section 501 to read as follows:
14 § 501. Authorization to accept application from retail licensees of
15 liquor and/or wine for off-premises consumption for retail food store
16 licenses. The department shall be authorized to accept applications from
17 retail licensees of liquor and/or wine for off-premises consumption for
18 a retail food store license in accordance with the provisions of section
19 one hundred thirty-two of the alcoholic beverage control law.
20 § 3. This act shall take effect on the sixtieth day after it shall
21 have become a law. Effective immediately, the addition, amendment and/or
22 repeal of any rule or regulation necessary for the implementation of

1 this act on its effective date are authorized to be made and completed
2 on or before such date.
